<br />The Court further finds that the administrator has accounted for all of the estate of the deceas-
<br />ed which came into his possession.
<br />IT IS, THEREFORE,ORDERED BY THE COURT that the report of Adolph Voss,administrator,be and the same
<br />hereby is approved and allowed as and for his final report.
<br />The Court further finds that notice was given to all creditors of the said Odi H.Voss,deceased,
<br />of the time limited and the place appointed for filing claims against said estate;that the time
<br />for filing claims has expired and that all claims filed and allowed have been paid,including
<br />funeral expense,and the expense of last illness,and that all claims outstanding against said est-
<br />ate,if any such there be-,are forever barred and precluded.
<br />IT IS,THEREFORE,CONSIDERED AND ADJUDGED BY THE COURT that all persons are forever barred from
<br />filing or setting up any claims against the estate of Odi H.Vosaxdeceased.
<br />The Court further finds that Odi H.Voss,deceased,departed this life intestate on the 24th of Jan -
<br />uary,l938;that she was at the time of her death,a resident of Hall County,Nebraska,and left sur-
<br />viving her the following named heirs,to -wit:
<br />Adolph Voss,her husband,
<br />Erwin A.Voss,a son,and
<br />Audrey H.Voss,a daughter, all of whom are of legal age.
<br />The Court further finds that the said Odi H.Voss was at the time of her death,the owner in fee
<br />simple title of the following described-real estate situated in Hall County,Nebraska,to -wit:
<br />An undivided one -half interest in the South Half (Sj) of Lot Five (5),and all of Lot Six (6) in
<br />Block Three (3) in Dawn Addition to the City of Grand lsland,Hall County, Nebraska;
<br />A rectangular tract of ground located in the Northeast quarter of Section Twenty -nine (29),Town-
<br />ship Eleven (11),Range Nine (9),Hall County,hebraska,more particularXy described as follows:
<br />Commencing at a point in the center of the section line between Sections Twenty(20) and Twenty -
<br />nine (29),in Township Elevn (11),Range Nine (9),fifty six feet ten inches east of an iron pin
<br />located six feet ten inches west of the center of the St.Joseph and Grand Island Railroad Right -
<br />of- Way,thence in a southerly direction parallel with the said St.Joseph and Grand Island Railroad
<br />Right- of -Way,a distance of 991 feet,thence in an easterly direction at right angles a distance of
<br />169 feet 4 inches,thence in a northerly direction at right angles a distance of 991 feet,thenee
<br />in a westerly direction to the place of beginning,a distance of 170-feet 10 inches,said tract con-
<br />taining 3.87 acres,a little more or less.
<br />And a tract of land described as follows:Commencing at a point 1326 feet west and 3155.2 feet south
<br />of the northeast corner of Section 29 in Township 11 North,Range 9, West of the 6th P.M.,in Hall
<br />County,Nebraska,and running south 612.9 feet along the one- sixteenth section line;thence west
<br />1251.E feet to the Right -of -Way of the St.Joseph & Grand Island Railway Company;thence north 616.9
<br />feet along the Right -of -Way of said St.Joseph & Grand Island Railway Company,thence east 1255.7
<br />feet,to "the point of beginning,and containing 17.7 acres,a little more or less.
<br />that under the Law of Descent of the State of Nebraska,all of the interest,right and title of the
<br />said Odi H.Voss in the above described real estate did pass and descend to Adolph Voss,Erwin A.
<br />Voss and Audrey H.Vose,share and share alike,subject,however,to the homestead rights of the said
<br />Adolph Voss.
<br />IT IS,THEREFORE,CONSIDERED AND ADJUDGED BY THE COURT that all of the above described property did
<br />pass and descend at the death of Odi H.Vose,intestate,to Adolph Voss,ohe -third thereof;to Erwin
<br />A.Voss,one -third thereof;and to Audrey H.Voss,one -third thereof;eubject to the homestead rights
<br />of the said Adolph Voss.
<br />The Court further finds that said estate is not subject to inheritance tax under the laws of the
<br />State of Nebraska or the laws of the United States.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED BY THE COURT that said administrator's report is
<br />approved,that said estate is closed and settled,and said administrator is discharged and his bond
<br />released.
<br />It is further found by the Court that all costs of administration have been paid,that Adolph Voss
<br />has advanced money with which to pay some of the claims against said estate,but that he has waived
<br />any claim for the money so advanced.
