LILLIE McINTOSH, DECEASED. )) On this 24th day of January, 1940.21 this cause came on for heating upon the Final Report of the Nebraska Loan & Trust Company of Grand Island, Nebraska, the duly appointed, qualified and acting Executor of the Estate of Lillie McIntosh, Deceased, and upon the petition of said Executor for the allowance and approval of said Report, the settlement of said estate, the distribution of the property and discharge herein, and the court, having examined the records and files herein and being fully advised in the premises finds that due and legal notice has been given to all persons of the time and place fixed by the court for the hearing upon said Final Report, and no one appearing to object to said report and the court having examined the same, together with the vouchers on file finds that said report is true and correct in all things and that the same ought to be approved and allowed as and for the final report of said Executor, said estate settled and closed and said Executor discharged. The Court further finds that the said Lillie McIntosh departed this life on the second day of August, 1939, and at the time of her death she was a resident and inhabitant of Hall County, Nebraska, and left a Last Will and Testament which was by the consideration of this court duly proven, allowed and admitted to probate on the 30th day of August, 1939; that the Nebraska Loan & Trust Company of Grand Island, Nebraska., was named as Executor in her said Last Will and Testa- ment and letters Testamentary were duly issued by this court to the said Nebraska Loan & Trust Company of the estate of Lillie'McIntosh, Deceased. The Court further finds that due and legal notice ha.s been given to all persons of the time and place fixed by the Court for filing claims against the estate of said deceased and that the time so fixed has fully expired and that all persons having claims against said estate and not filed within the limited time fXx6d by the court are forever barred and excluded from setting up or asserting any such claims against said estate. The Court further finds that the said Executor has paid the funeral expenses of said estate, all debts against said estate, and the cost of this proceeding and has made due distribution of the residue of the personal property of said deceased, including payment of specific bequests and assignment of certain specified assets and has made delivery of the remaining assets to Adda Nicolay and Albert C.Schmutz,share and share alike, pursuant to the terms and conditions of said Will and nothing further remains in the hands of said Executor belonging to said estate. The Court further finds that the bequest to Burk L.Pinkerton is subject to a state inheri- tance tax of $5.00 and the bequest to Rev. Edgar White is subject to a $1.00 state inheritance tax under the laws of the State of Nebraska, which tax has been paid, and that is is not subject to a Federal Estate Tax under the laws of the United States. The Court further finds that the said Lillie McIntosh died seized as the owner by fee simple title of the following described real estate, to -wit: The West Forty -four (W44) feet of Lot Three (3) Block Thirty-"Three (33), Original Town, now City of Grand Island,Hall County, Nebraska; and Lots Seventy -five (75) and Seventy -six (76), Belmont Addition to Grand Island,Hall County, Nebraska.
