<br />LAST WILL AND TESTAMENT
<br />OF
<br />JAh ES A. SPRAGUE
<br />I, James A.Sprague, of Harrison Township, Hall County, Nebraska, being of sound mind and disposing
<br />memory, but not unmindful of the uncertainties of human life, do hereby make, publish and deblare
<br />this, my last Will and Testament, hereby revoking all former Wills by me made;
<br />FIRST
<br />I direct that my just debts and funeral expenses be first paid out of my estate.
<br />SECOND.
<br />I give, devise and bequeath unto my beloved wife, Amelia Sprague, the following described real
<br />estate: The Southeast Quarter (SE4) of Section Twenty -two (22), Township Eleven (11) North of
<br />Range Eleven (11), West of the 6th P.M. and the South Half (SJ) of the Southeast Quarter (1EJ) of
<br />Section Tvienty -three (23), Township Eleven (11) North of Range Eleven (11) west of the 6th P.M.,
<br />both in Harrison Township, Hall County, Nebraska, for and during her natural life.
<br />THIRD.
<br />After the death of my beloved wife, Amelia Sprague, I give and devise unto my son, Edward Sprague,
<br />and to his heirs and assigns forever, in fee simple absolute, the following described real estate:
<br />the South' Half (Sz) of the Southwest Quarter (SW4) of Section Twenty -three (23), Township Eleven
<br />(11) North of Range Eleven (11) West of the 6th P.M. in Hall County, Nebraska.
<br />FOURTH.
<br />After the death of my beloved wife, Amelia Sprague, I give, devise and bequeath unto my daughter,
<br />Florence Sprague, and to her heirs and assigns forever, in fee simple absolute, the following des-
<br />cribed property, towit: The South Half (S2) of the Southeast Quarter (SEJ) of Section Twenty -two
<br />(22) Township Eleven (11)- North,Range Eleven.(11) West of the 6th P.M., in Hall County, Nebraska.
<br />FIFTH.
<br />After the death of my beloved wife, Amelia Sprague, I give, devise and bequeath unto my daughter,
<br />Bessie Sprague Martin, the following described real estate, tdwit: The North Half (NJ) of the
<br />Southeast Quarter (SE-4-0 of Section twenty -two (22) Township Eleven (11) North of Range Eleven
<br />(11), West of the 6th P.M., Hall County, Nebraska, for and during her natural life with remainder
<br />over to the heirs of her body, provided, however, that she, the said Bessie Sprague Martin, shall
<br />not sell, mortgage lien or otherwise transfer or encumber her said interest and in the event she
<br />shall do so, her life estate shall immediately cease and determine and the fee title to the premises
<br />hereinbefore devised shall vest in the heirs of her body, and provided further that if any heir
<br />of her body shall die before she does, leaving no children, that the interest of said deceased
<br />heir of her body, shall pass to the surviving heir or heirs of her body.
<br />SIXTH.
<br />The rest and residue of my estate of which I may die possessed of any and all natures whatsoever
<br />and wheresoever situated, I give, devise and bequeath unto my beloved wife, Amelia Sprague, to
<br />be here absolutely.
<br />SEVENTH
<br />The devise and bequest to my beloved wife, Amelia Sprague, shall be in lieu of any distributive
<br />share of my estate given her by law, including the right of support, homestead rights and statu-
<br />tory exemptions.
<br />EIGHTH.
<br />I hereby nominate, constitute and appoint my daughters, Bessie Sprague Martin and Florence Sprague
<br />to be the executrices of this, my last Will and Testament and hereby request that no bond be re-
<br />quired of them, except their oven obligations.
<br />Dated at Grand Island, Hall County, Nebraska, this 27th day of September, 1932.
