<br />LAST WILL AND TESTAMENT
<br />OF
<br />CLAUS FF3ANZENBURG
<br />In the .Name of God, Amen.
<br />Claus Franzenburg, of Central City, Nebraska, being
<br />sidering the certainty of death and the uncertainty
<br />settle my wordly affairs, and thereby be the better
<br />please the Almighty to call me hence, do therefore
<br />ment, hereby revoking and annulling all Wills by me
<br />MA
<br />of sound mind, memory and understanding, con -
<br />of the time thereof, and being desirous to
<br />prepared to leave this "world when it shall
<br />nake and publish this my last Will and Testa -
<br />heretofore rude, in manner and form following,
<br />that is to Say:
<br />FIRST, and principally, I commit my soul into the hands of Almighty God, and my body to the earth,
<br />to be decently buried at the discretion of my Executor hereinafter named; and my Will is, that
<br />all my just debts and funeral expenses shall be paid by my Executor hereinafter named as soon
<br />after my decease as shall be convenient, including the mortgage oh my real estate.
<br />SECOr1D, I give, devise and bequeath to my wife, Emilie Franzenburg, my home farm of One Hundred
<br />Forty (140) acres, to -wit: the North 60 acres of the East half of the Northwest Quarter of Section
<br />2, Township 12, Range 7 and the Southeast Quarter of the Southwest Quarter and the Southwest Quarter
<br />of the Southeast Quarter of Section 35, Township 13 Range 7, west of the 6th P.M., all in Merrick
<br />County, Nebraska, to have and to hold the use thereof for and during her natural lifetime, but
<br />with no power to sell nor encumber the same. I also give to my said wife the income from my 240
<br />acre farm in Hall County, Nebraska, for the period of her natural lifetime, but with no power to
<br />sell nor encumber the same.
<br />THIRD, in case of the death of my said wife, before her contemplated return to her home from our
<br />trip to Europe, I request that my 140 acre farm, above described, be sold to my son Herbert Fran-
<br />zenburg when he attains the age of twenty -one years, for the sum of $130.00 per acre, and that my
<br />240 acre farm in Hall County, Nebraska be sold to my daughter, Anna Peters, when she attains the
<br />age of 21 years, for the sum of $70.00 per acre. The sums so derived from the sale of these
<br />two farms is to be equally divided among my three children, Anna Peters, Herbert Franzenburg and
<br />Martha Ellen Franzenburg. In case of the prior death of any my said children, without leaving
<br />issue, the proceeds shall be divided among the remaining.children. In case issue is left, the
<br />share of such deceased child shall not lapse, but shall descend to such issue. I. further provide,
<br />that neither of my two farms, above described, shall be disposed of until after a period of twenty
<br />years after the child owning the farm shall have attained the age of 21 years.
<br />AND LASTLY, I do hereby nominate, constitute and appoint Wilhelm Wenn, of Grand Island,Nebraska,
<br />Executor of this my last Will and Testament, and I desire that my Executor hereinbefore named
<br />shall not be required to give bond for the faithful performance of the duties of that office.
<br />IN TEST111ONY WHEREOF, I have set my hand and seal to this, my last Will. and Testament, at Chapman,
<br />Nebraska, this 19th day of April, in the year of our Lord, one thousand nine hundred and twenty -
