<br />the balance on hand after the payments of all claims against said estate, Court costs, attorney
<br />fees and expenses of administration is 3,790.99, and all other personal property as shown in the
<br />Inventory is hereby awarded to Mildred Smith under and by virtue of the terms and provisions of the
<br />last will and testament of the said Sarah A.Nicholson, deceased; that said real estate above des-
<br />cribed did pass and descend, under the terms and provisions of said last will and testament, to
<br />Gordon Smith and Maurice Smith, in fee simple title, equally share and share alike, to each a one -
<br />half share.
<br />That said estate has been appraised and is not subject to the payment of any inheritance tax,
<br />either by virtue of the laws of the State of Nebraska or the United States government, and that
<br />the final report filed herein by Mildred Smith, executrix, should be approved and allowed as and
<br />for her final report, said estate settled and closed, said executrix discharged and her bond re-
<br />leased from any further liability in said matter.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims
<br />against said estate not filed within the time provided by order of this Court, if any such there
<br />be, are hereby barred and excluded from setting up or asserting any such claims against said estate.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report filed herein by
<br />Mildred Smith, executrix, be and the same is hereby approved and allowed, as and for her final
<br />report, said estate settled and closed and said executrix discharged and her bind released from
<br />any further liability in said matter, and that all personal property, including the balance in
<br />cash now on hand, did pass and descend under and by virtue of the last will and testament of the
<br />said Sarah A.Nicholson, deceased, to Mildred Smith, and that the real estate hereinbefore descrbied
<br />did pass and descend to the decedent's grandsons, Gordon Smith and Maurice Smith, in fee simple
<br />title, equally share and share alike, to each a one -half share, according to the terms and provi-
<br />sions of said decedent's will.
