<br />The Court further finds.that the estate of the deceased is subject to an inheritance tax under the

<br />finds that the said William B.Waite departed this
<br />life on the 27th day of March
<br />1939, and at the
<br />time of his death he was a resident and inhabitant
<br />of Hall County, Nebraska; that
<br />he left surviving
<br />him as his heirs -at -law and only heirs -at -law, his
<br />wife Cora A.Waite and two
<br />daughters, Opal M.Piersol
<br />and Viva Bernice Butler; that he left a Last Will and Testament and
<br />An undivided one -half interest in the Northeast Quarter (NEa) of Section One (1), Township Eleven
<br />Codicil thereto,
<br />which were by the consideration of this Court duly
<br />proven, allowed and admitted
<br />the other half being owned by Cora A.Walte, tenant in common;
<br />to probate on the
<br />29th day of April, 1939, and letters Testamentary
<br />were duly issued by this Court
<br />West of the 6th P.M., and that part of the Northeast Quarter (NE4) of Section Fifteen (15), Town-
<br />to the said Cora
<br />A.Waite, Opal M.Piersol and Viva Bernice Butler of
<br />the estate of William B.Waite,
<br />Burlington Railroad right -of -way, Hall County, Nebraska, containing 169 or 170 acres;
<br />Deceased.
<br />The Court further finds that due and legal notice has been given to all persons of the time and
<br />place fixed by the Court for filing claims against the estate of said deceased and that the time
<br />so fixed has fully expired and that all persons having claims against said estate and not filed
<br />within the time limited by the Court are forever barred and excluded from setting up or asserting
<br />any such claims against said estate.
<br />The Court further finds that said Executrices have been paid the funeral expenses of said deceased
<br />all debts against said estate, and the costs of these preceedings and have made due distribution
<br />of the residue of the personal estate of said estate of said deceased to the legatees under the
<br />Will and Codicil of the deceased and nothing further remains in the hands of the Executrices be-
<br />longing to said estate.
<br />The Court further finds.that the estate of the deceased is subject to an inheritance tax under the
<br />laws of the State of Nebraska in the sum of $98.65, which amount has been paid, and subject to a
<br />Federal Estate Tax under the laws of the United States which has been ;)aid.
<br />The Court further finds that of the real estate described in the Last Will and Testament and Codicil
<br />of the said William B.Waite, he died seized as the owner by fee simple title of the following des-
<br />cribed real estate .in Hall County, Nebraska, to -wit:
<br />The Northeast (NE4) of Section Thirty -six (36), Township Twelve (12), North, Range Twelve (12),
<br />West of the 6th P.M., Hall County, Nebraska, containing 160 acres;
<br />An undivided one -half interest in the Northeast Quarter (NEa) of Section One (1), Township Eleven
<br />(11), North,Range Twelve (12) West of the 6th P.M._, Hall County, Nebraska, totaling 80 acres,
<br />the other half being owned by Cora A.Walte, tenant in common;
<br />The Southeast Quarter (SE4) of Section Ten (10), Township Twelve (12),North,Range Twelve (12),
<br />West of the 6th P.M., and that part of the Northeast Quarter (NE4) of Section Fifteen (15), Town-
<br />ship Twelve (12), North, Range Twelve (12), West of the 6th P.M., lying north and east of the
<br />Burlington Railroad right -of -way, Hall County, Nebraska, containing 169 or 170 acres;
<br />The Southwest Quarter of the Northeast Quarter (SW14NE4) and Part of the Southeast Quarter of the
<br />Northeast Quarter (SE14NE4) of Section Twenty -four (24), Township Twelve (12), North,Range Twelve
<br />12),West of the 6th P.M., Mall County, Nebraska, containing approximately 40 acres;
<br />The Northeast Quarter (NEI) of Section Twenty -three (23), Township Twelve (12), North, Range
<br />�th
<br />Twelve (12), West of the P.M., Hall County, Nebraska, containing 160 acres;
<br />Lots Fifteen (15), and Sixteen (16), Block Five (5) Village of 'Cairo, Hall County, Nebraska.
<br />The Court further finds that the description in the Will and Codicil of the real estate located
<br />in Howard County, Nebraska, is erroneous and that the said William B.Waite died seized as the
<br />owner by fee simple title of the following described real estate only in Howard County, Nebraska,
<br />to -wit:
<br />The West Half of the Southeast Quarter of the Southeast Quarter (WI2 SEISE4) of Section Thirty -five
<br />(35), Township Thirteen (13) North,Range Twelve (12),West of the 6th P.M., Howard County, Nebraska,
<br />containing 20 acres.
<br />The Court further finds that all other real estate described in the Last Will and Testament and
<br />Codicil of the said William B.Waite, Deceased, had either been conveyed by him by deed prior to
<br />his death or was owned by him and Cora A.Waite, or the survivor of them, as joint tenants and not
<br />as tenants in common, and is therefore not affected by the terms and provisions of said Last Will
<br />and Testament and Codicil.
<br />The Court further finds that under the terms and provisions of the Last Will and Testament and
<br />Codicil of the said William B.Waite, deceased, all of the real estate hereinabove described as
<br />
