<br />It further appearing from the testimony of Gladys Breitweiser, one of the subscribing witnesses
<br />to said Will, who appeared and testified in open court that she was present at the execution of
<br />said Last Will and Testament, and triat she saw the said Leitha Senseney sign the same and heard
<br />the said Leitha Senseney acknowledge the same as her Latt Will and Testament, and she, at her
<br />request and in her presence, and in the presence of L.G.Johnson, on the date of the execution
<br />thereof, subscribed her name to said Will as attesting witnesses thereto and that she believed
<br />the said Leitha Senseney to be of sound and disposing mind and memory and under no restraint; and
<br />It further appearing from the testimony of Gladys Breitweiser that L.G.Johnson, now deceased, one
<br />of the subscribing witnesses to said Will, was present at the execution of said Last Will and Testa-
<br />ment and saw the said Leitha Senseney sign.the same and heard the said Leitha Senseney acknowledge
<br />the same as her Last Will and Testament; and that the said L.G.Johnson, at the request of Leitha
<br />Senseney and in the presence of Leitha Senseney and in the presence of Gladys Breitweiser, on
<br />the date of the execution thereof, subscribed his name to said Will as attesting witness thereto,
<br />and that the said Testatrix signed said Will in the presence of L.G.Johnson and Gladys Breitweiser,
<br />and that Gladys Breitweiser and L.G.Johnson signed said instrument as attesting witnesses in the
<br />presence of each other and in the presence of the Testatrix at the request of Leitha Senseney.
<br />It further appearing, from the testimony of Gladys Breitweiser and C.E.Robison that each of said
<br />parties was acquainted with the signature of L.G.Johnson, and t'iat what purports to be the signa-
<br />ture of L.G.Johnson, as attesting witness to the Last Dill and Testament of Leitha Senseney; is
<br />the signature of L.G.Johnson, and that the said L.G.Johnson departed this life on February third,
<br />1931.
<br />The Court being now sufficiently advised in the premises, IT IS ORDERED AND DECREED that the afore-
<br />said proofs be filed and that said Will be, and the same hereby is, duly admitted to probate as
<br />and for the Last Will and Testament of Leitha Senseney, deceased, and that the same be entered of
<br />record.
<br />It is further ordered that upon taking the oath as Executor that Letters Testamentary issue to
<br />Ralph H.Senseney, the executor named in said Will, and that the same be filed and entered of record.

<br />KNOW ALL MEN BY THESE PRESL14TS: That I, Leitha Senseney, of Fort Morgan, Colorado, being of sound
<br />and disposing mind and memory do hereby make, declare and publish this my Last Will and Testament
<br />In the words, form and manner following, to -wit:
<br />1. IT IS MY WILL and it is hereby so directed, that all my just debts and the expenses incident
<br />to my last illness and funeral shall be paid.
<br />2. I give and devise unto my beloved husband, Ralph H.Senseney, our residence property in Fort
<br />Dorgan, Colorado, particularly described as follows, to -wit:
<br />The north twenty (?0) feet of lot twenty -seven (27), and all of lot twenty -eight (28), in Block
<br />fifteen (15), Riverside Addition to the town (now city) of Fort Morgan, Colorado,
<br />TO HAVE AND TO HOLD as his absolute estate of inheritance in law and in fee simple forever.
<br />3. I GIVE AND DEVISE unto my beloved son, Ralph Harlan Senseney, the following described real
<br />estate, situate in the County of Hall and State of Nebraska, to -wit:
<br />The southwest quarter of the northeast quarter (SWJNE4) of Section twenty -four (24), in Township
<br />eleven (11), Range twelve (12), containing forty (40)_acres, more or less, according to the Govern-
<br />ment Survey, thereof,
<br />TO HAVE AI ,JD TO HOLD as his absolute estate of inheritance in law and Afee simple forever, provided,
<br />however, that my husband, Ralph H. Senseney shall have the rental proceeds derived or realized
<br />from said land, after deducting a sum sufficient thereform to pay the annual taxes each year and
