<br />Leona Zima, Milo Zima and Dalores Zima, grandchildren and children of Ed Zima a deceased son of
<br />said Frank Zima who predeceased his father the said Frank Zima.
<br />That at the time of his death Frank Zima was the owner in fee simple and in possession thereof of
<br />The Southeast Quarter of the Southwest Quarter of Section Eleven, Township Sixteen,North,Range
<br />Three and
<br />The North Half of the Souteast quarter of Section Thirty One, Township Thirteen, North,Range One,
<br />East of the Sixth Principal Meridian and
<br />Lot Five in Block Six in Miles' Sixth Addition to David City, Nebraska, all of said heretofore
<br />mentioned and described property being located in Butler County, Nebraska, and
<br />Lot Eight in Block Thirty Eight in Russel Wheeler's Addition to the City of Grand Island, in Hall
<br />County, Nebraska.
<br />The Court finds that the bequests of the sum of Five Hundred Dollars to each of the following named
<br />persons to -wit: Mary Zima, widow, Molly Janak, Agnes Shonka, Rosie Johannes and Caroline Medinger,
<br />all as provided for by virtue of paragraph number two of said Last Will and Testament have been paid
<br />by the Executor and the Court takes judicial notice of the receipts filed herein showing that such
<br />payment has been made.
<br />That all the debts, funeral expenses, court costs and attorney's fee have been paid in full.
<br />That all of the provisions of said Last Will and Testament of said Frank Zima have been satisfied
<br />in full.
<br />That the Southeast Quarter of the Southwest Quarter of Section Eleven, Township Sixteen, North,
<br />Range Three, East of the Sixth Principal keridian in Butler County, Nebraska by virtue of the terms
<br />of paragraph 3 of said last will and testament is given, granted and set over to Joseph Zima and
<br />the Court hereby confirms said paragraph and said title to said Joseph Zima.
<br />That Lot Eight in Block Thirty Eight of Russel Wheeler's Addition to the City of Grand Island,
<br />Nebraska, by virtue of paragraph four of said last will and testament is given, granted and set
<br />over to Louis Zima and the Court hereby confirms said paragraph four and said title in said Louis
<br />Zima. The Court further finds that said paragraph four gives and grants a life use in said real
<br />estate to Mary Zima, the wife of said Frank Zima, deceased, said Mary Zima to receive the rents
<br />from said real estate after the taxes and insurance are paid and after the death of said Mary Zima,
<br />the title to said real estate and all the hereditaments thereon to become the property of said
<br />Louis Zima absolutely.
<br />That the North Half of the Southeast Quarter of Section Thirty -One, Township Thirteen, North,Range
<br />One, East of the Sixth Principal Meridian in Butler County, Nebraska by virtue of paragraph five
<br />of said last will and testament is given, granted and set over to Thomas Zima and the Court hereby
<br />confirms said paragraph five and the title of said Thomas Zima. The Court further finds that
<br />said paragraph five gives and grants a life use in said real estate to Mary Zima, the wife of
<br />said Frank Zima, deceased., said Mary Zima, to receive two fifths 'of all the net income from said
<br />premises during the term of her natural life and after the death of said Mary Zima, the title to
<br />said real estate and all the hereditaments thereon to become the property of said Thomas Zima
<br />absolutely. The Court further finds that a charge in the sum of Ten Dollars is placed on said
<br />property for the use and benefit of Frank Zima, the son of said deceased, and the Court further
<br />finds that said Thomas Zima paid the sum of Ten Dollars into this Court for the use and benefit of
<br />sadd Frank Zima on the 19th day of September, 1939 and said charge is therefore paid and satisfied
<br />and is of no further force and effect and is hereby discharged. The Court further finds that a
<br />charge in the sum of One Hundred Dollars to be paid to each of the children of Edward Zima, namely
<br />Leona Zima, Milo Zima and Dalores Zima, by virtue of said paragraph five of said last will and tes-
<br />tament, is placed as a further charge on said real estate and the Court finds that said Thomas Zima
<br />paid said charge, amounting to the sum of $300.00 to Louis Zima, the duly appointed, qualified and
