Mom M N� K We � 0, <br />The Court finds that the bequests of the sum of Five Hundred Dollars to each of the following <br />named persons to -wit: Mary Zima, widow, Molly Janak, Agnes Shonka, Rosie Johannes and Caroline <br />Medinger, 911 as provided for by virtue of paragraph number two of said Last Will and Testament <br />have been paid by the Executor and the Court takes judicial notice of the receipts filed herein <br />showing that such payment has been made. <br />That all the debts, funeral expenses, court costs and attorneys fee have been paid in full. <br />That all of the provisions of said Last Mill and Testament of said Frank Zima, have been satisfied <br />in full. <br />Thatthe Southeast quarter of the Southwest quarter of Section 112 Township 16, North,Range 3 in <br />Butler County, Nebraska, by virtue of the terms of paragraph 3 of said last will and testament is <br />given, granted and set over to Joseph Zima and the Court hereby confirms said paragraph and said <br />title in said Joseph Zima. <br />That Lot Eight in Block Thirty Eight of Russel Wheeler's Addition to the City of Grand Island, <br />Nebraska, by virtue of paragraph four of said last will and testament is given, granted and set <br />over to Louis Zima and the Court hereby confirms said paragraph four and said title in said Louis <br />Zima. The Court further finds that said paragraph four gives and grants a life use in said real <br />estate to Mary Zima, the wife of said Frank Zima, deceased, said Mary Zima to receive the rents <br />from said real estate after the taxes and insurance are paid and after the death of said Mary <br />Zima, the title to said real estate and all the hereditaments thereon to become the property <br />of said Louis Zima Zima absolutely. <br />That the North Half of the Southeast Quarter of Section Thirty One, Township Thirteen, North, <br />Range One East of the Sixth Prin�ipal Meridian, in Butler County, Nebraska by virtue of paragraph <br />five of said last will and testament is given, granted and set over to Thomas Zima and the Court <br />hereby confirms said paragraph five and the title of said Thomas Zima. The Court further-finds <br />that said paragraph five gives and grants a life use in said real estate to Mary Zima, the wife <br />of said Frank Zima, deceased, said Mary Zima to receive two fifths of all the net income from <br />said premises during the term of her natural life and after the death of said Mary Zima, the title <br />to said real estate and all the hereditaments thereon to become the property of said Thomas Zima <br />absolutely. The Court further finds that a charge in the sum of Ten Dollars is placed on said <br />property for the use and benefit of Frank Zima and the Court further finds that said Thomas Zima <br />paid the sum of Ten Dollars into this Court for the use and benefit of said Frank Zima on the 19th <br />day of September, 1939, and said charge is therefore paid and satisfied and is of no furthdr force <br />and effect. The Court further finds that a charge in the sum of One Hundred Dollars to be paid <br />to each of the children of tdward Zima namely Leona Zima, Milo Zima and Dalores Zima, by virtue <br />of said paragraph five of said last will and testament, is placed as a further charge on said <br />real estate and the Court finds that said Thomas Zima paid said charge, amounting to the sum of <br />$300.00 to Louis Zima the duly appointed, qualified and acting Guardian of said Leona Zima, Milo <br />Zima and Dalores Zima on the 23 day of October, 1939 and that by virtue of said payment the said <br />charge is therefore paid and satisfied in full and is of no further force and effect. <br />That Lot Five in Block Six in Miles' Sixth Addition to David City, Nebraska, by virtue of the <br />terms of paragraph six of said last will and testament is given, granted and set over to Carolina <br />Medinger, also known as Caroline Medinger and the Court hereby confirms said paragraph and said <br />title in said Caroline Medinger. The Court finds that said paragraph six gives and grants a life <br />use in said real estate and the tenements located thereupon to Mary Zima, the wife of said de- <br />ceased. The Court further finds that said Mary Zima now occupies said premises as a homestead and <br />that said homestead and life use have merged. <br />That all the balance and residue of all personal property by virtue of paragraph seven of said <br />last will and testament are given, granted and set over to Mary Zima, the widow of said deceased <br />and the Court takes judicial notice of the receipt of said Mary Zima:,, widow, herein filed showing <br />that all the rest and residue of said property has been received by her and the Court hereby <br />grants and confirms said bequest to said Mary Zima, widow. <br />The Court finds that the time for filing claims against said estate has passed and expired accord- <br />ing to law and the order of the Court and that all claims, if any, not filed have been barred by <br />law and the Order of this Court. <br />The Court finds that the estate of Frank Zima is free from and not subject to any State Inheritance <br />Tax or Federal Estate Tax. <br />WHEREFORE IT IS ORDERED, ADJUDGED AND DECREED: <br />That the Court has jurisdiction of the subject matter and the parties and to make and enter this <br />Decree. <br />That Frank Zima, a resident of Butler County, Nebraska, died testate therein on the 17th day of <br />February, 1939, and that his Last Will and Testament was duly admitted to probate and probated <br />as such Last Will and Testament. <br />That at the time of his death, Frank Zima left surviving him as his sole and only heirs the fol- <br />lowing named persons to -wit: Mary Zima, his widow, Molly Janak, Agnes Shonka, Rosie Johannes, <br />Caroline Medinger daughters and Joseph Zima, Thomas Zima, Frank Zima and Louis Zima, sons, and <br />
