<br />and place appointed for the filing of.claims against said estate; that the time so allowed for
<br />filing claims has fully expired; and that any claims outstanding against said estate, if not so
<br />filed, if any such exist, are forever barred and precluded.
<br />The Court further finds that the said Mary Deisel, departed this life on the 12th day of April,
<br />1937; that she left a last will and testament, which instrument was duly approved, allowed and
<br />admitted to probate in the Probate Court of La Salle County, in the State of Illinois; that due
<br />notice was given to all persons interested in said estate as to the time and place fixed for the
<br />hearing upon petition to admit said will to probate; an$ that said will was duly admitted to pro-
<br />bate in La Salle County, Illinois, on the 10th day of June, 1937; that a duly authenticated copy
<br />thereof and its admission to probate in said court was duly filed in the office of the County
<br />Judge of Hall County, Nebraska, on January 91 1939•
<br />The Court further finds that the said Mary Deisel, deceased, died seized in fee simple title of
<br />the following described property, to -wit:
<br />the East Half of the Northeast quarter (EJNEJ of Section Twenty -seven (27)2 Township Ten (10),
<br />Range Nine (9), in Hall County, Nebraska, consisting of eighty acres, a little more or less,
<br />according-to the government survey thereof.
<br />The Court further finds that.Harold S.Barr was named as executor under the last will and testament
<br />of Mary Deisel, deceased; that he failed to qualify as such executor; and that under the terms and
<br />provisions of the will of Mary Deisel, deceased, it was provided that in the event of the failure
<br />of Harold S.Barr to qualify as such executor, that the said Carter H.Weisheit be named as executor

<br />of said estate.
<br />The Court further finds that the said Carter H.Weisheit was the duly appointed executor of said
<br />estate under the laws of the State of Illinois; and that the estate of Mary Deisel, deceased, wpa
<br />duly probated in said county and state.
<br />The Court further finds that a duly authenticated copy of said will and of its admission to probate
<br />in La Salle County, Illinois, was filed in the office of the County Judge of Hall County, Nebraska,
<br />as required by lave; that due notice was given to all persons of the filing of the petition for the
<br />probate of said will in the County Court of Hall County, Nebraska; that no one appeared to object
<br />to the admission of said will to probate; and that said will was duly admitted to probate in the
<br />County Court of Hall County, Nebraska, under date of February 28, 1939, and that a copy thereof
<br />was recorded in the office of the County Judge of Hall County, Nebraska.
<br />The Court further finds that the said Mary Deisel died seized in fee simple title of the follow -
<br />ing described premises, to -wit:
<br />the East Half of the Northeast quarter (EJNEJ) of Section Twenty -seven (27), Township Ten (10)
<br />Range Nine (9), in Hall County, Nebraska, consisting of eighty acres, a little more or less, accord-
<br />ing to the government survey;
<br />and that under the terms and provisions of the last will and testament of Mary Deisel, deceased,
<br />the said Carter H.Weisheit was duly authorized to sell and convey said real estate either at pub-
<br />lic or private sale; and that said executor was authorized to execute, acknowledge and deliver a
<br />deed of conveyance for said real estate; that after the payment of the costs of administration,
<br />debts and funeral expense, that the proceeds received from said real estate should be divided in
<br />five equal parts:
<br />One share thereof to be divided equally among the children of Ella Hasenjager, deceased;
<br />One share thereof to be divided equally among the children of William Sennholtz, deceased;
<br />One share thereof to be divided equally among the children of Anna Schreck;
<br />One share thereof to Elizabeth Hildebrandt, a half- sister of August Deisel, deceased;
<br />One share thereof to William Keller, a son of a deceased brother of Mary Deisel, deceased;
<br />and the proceeds of said premises is hereby awarded to said heirs in _accordance with the terms
<br />of said will.
<br />The Court further finds that the said Carter H.Weisheit sold said premises above described to
<br />Henry C.Meier of Doniphan, Nebraska, for the sum of Thirty -two Hundred ($3200.00) Dollars; that
<br />said proceeds was the fair, reasonable market value thereof; and that said sale. was hereby
<br />approved by this Court.
