364 <br />WILL AND DECREE RECORD <br />THE AUGUSTINE CO. 18800 -12 -88 <br />his grand- children,the children of William Windolph,a deceased son of the said John Peter Windolph. <br />FOURTH <br />That on said 24th day of <br />December,1929,an order of this <br />Court was made allowing creditors three <br />months in which to file <br />their claims against said estate <br />and further ordering that a notice of <br />the same be published in <br />the Grand Island Daily Independent,said newspaper printed and published <br />in said County,three successive <br />weeks prior to the 21st <br />day of April,1930,and it appears by proof <br />on file that notice of said <br />order was published therein <br />on the 31st day of December,1929,the 7th <br />day of J anuary,1930,and <br />the 14th day of January,1930,as <br />directed in said order. <br />FIFTH <br />The Court further finds that on the 12th day of Ju1y,1930,said administrator filed in Court his <br />inventory of the property of said estate, and that according thereto the deceased died seized and <br />possessed of the following described property,to -wit: <br />IS tract of ten (10) acres,described as follows :Commencing at the northwest corner of the East Halt <br />of the Northwest Quarter of Section 14,Township Eleven North,Range 9,West of the 6th P.M.,thence <br />South eighty rods,thence East Twenty rods,thence North Eighty rods,thence West Twenty rods to the <br />place of beginning,all in Hall County,Nebraska. <br />Block Eleven of Koehler Subdivision located on part of the Southeast Quarter of the Southwest <br />Quarter of Section Fifteen Township Eleven North,Range Nine,West of the 6th P.M.and part of Lot <br />Fourteen of County Subdivision of West Half of Southwest quarter Section Fifteen,Township Eleven <br />North,Range Nine,West of the 6th P.M.,Hall County,Nebraska, <br />A one -ninth interest in the Estate of Katherine Windolph,deceased Household furniture of the <br />approximate value of $500.00 <br />Accounts of the value of x$1,123.00 and that the said property was at the time of the death of the <br />deceased and at this time,wotth less than $12,000.00. <br />SIXTH <br />The Court further finds that according to the laws of descent and distribution said property des- <br />cended as follows,to- wit :Hugo Windolph,Otto Windolph,Clara Windolph Schultz,Walter Windolph,Albert <br />Windolph,Elsie Windolph Lassen in equal shares and one share to Harold Windolph and Phyllis Windolph, <br />the children of William Windolph,a predeceased son of the said John Peter Windolph. <br />SEVENTH <br />The Court further finds that on the 19th day of August,1939,an order of this Court was made barring <br />all claims not filed against said estate,that all persons holding a claim or a pretended claim <br />against the deceased or this estate are forever barred or enjoined from filing or setting up such <br />claim or pretended claim;that all debts and claims against said estate and the costs of administ- <br />ration in said estate have been paid out of the funds in the hands of said administrator and that <br />there remains no money in his hands and that the following are the persons entitled to receive and <br />to take the real estate as set forth in paragraph 6th of this decree,to- wit :Hugo Windolph,Otto <br />Windolph,Clara Windolph Schultz,Walter Windolph,Albert Windolph,Elsie Windolph Lassen and Harold <br />Windolph and Phyllis Windolph. <br />EIGHTH <br />The Court further finds that this estate is not subject to inheritance tax nor are the heirs liable <br />for any inheritance tax due the State of Nebraska nor liable to the United States of America for <br />any estate tax whatsoever. <br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREED BY THE COURT that the final report of the administrator <br />in said estate be and the same is hereby approved and allowed as such and that Hugo Windolph,Otto <br />Windolph,Clara Windolph Schultz,Walter Windolph,Albert Windolph and Elsie Windolph Lassen,Harold <br />Windolph and Phyllis Windolph are all and the only heirs of the said deceased and that the property <br />described in paragraph Fifth hereof descends according to the laws of descent and distribution of the <br />State of Nebraska as found in paragraph Sixth of this Decree and that an order of distribution be <br />idsued to the said Hugo Windolph out of and under seal of this Court. <br />In Witness whereof I have hereunto set my hand and the seal of this Court this 23rd day of August,1939. <br />Paul N.Kirk <br />County Judge <br />
