<br />DECREE.
<br />1,!IATHILDA A.DETWILER,Deceased. )
<br />Now on this 16th day of August,1939,this matter came on for hearing,upon the petition of Christian
<br />B.Leth and Anna L.Leth,for a decree for the determination of the time of the death of Mathilda A.
<br />Detwiler,deceased and the determination of the heirs of said deceased and their degree of kinship,
<br />and the right of descent of the real property belonging to said deceased and upon the evidence
<br />introdued in support thereof and the Court being fully advised in the premises finds: That due
<br />notice of the time and place of hearing upon the petition of Christian B.Leth and Anna L.Leth,
<br />has been given to all persons interested in said estate,both creditors and heirs,by publication
<br />as provided by law.
<br />That Mathilda A.Detwiler departed this life at Omaha,Douglas County,Nebraska,on October 17,1909,
<br />leaving no last Will and Testarnent.That said deceased was at and immediately previous to her
<br />death,an inhabitant of said Douglas County,Nebraska.
<br />That at the time of her death,said decedent was seized and possessed of an interest in certain
<br />real estate,situate in Hall County,Nebraska,to -wit: Lot One (1) in Block Seventeen (17) kn Arnold
<br />and Abbott's Addition to the City of Grand Island,Hall County,Nebraska.
<br />That on the 27th day of January,1910,Augustus K.Detwiler filed a petition for letters of adminis-
<br />tration on the estate of Mathilda A.Detwiler,deceased,and that on the 23rd day of February 1910,
<br />Letters of administration were granted to Augustus K.Detwiler.
<br />That thereafter notice was given to creditors and on September 26,1910,an order was entered in
<br />said estate barring all claims.That said estate of Mathilda Detwiler has become dormant for failure
<br />of the administrator to file any report therein for more than twenty -eight years,and that no decree
<br />of heirship has been entered in said estate.That all claims against said estate have been paid or
<br />barred by the ,Statute of limitations.
<br />That said deceased,Mathilda A.Detwiler,left her surviving as her sole and only heirs at law and
<br />the only persons interested in her estate,the following:

<br />that Mathilda A.Detwiler
<br />departed this life at
<br />Omaha,Douglas County,Nebraska,on October 17,1909,leaving no last Will and Testament and was at
<br />the time of her death a resident of Douglas County,Nebraska.
<br />That the said deceased,klathilda A.Detwiler died seized and possessed of an interest in certain
<br />real eatate,aituate in Hall County,Nebraska,to -wit: Lot One (1) in Block Seventeen (17) in Arnold
<br />and Abbott's Addition to the City of Grand Island,Hall County,Nebraska.
<br />That said estate of Mathilda Detwiler has become dormant for failure of the administrator to file
<br />any report therein for more than twenty -eight years,and that further administration of her estate
<br />be dispensed with.
<br />That said Mathilda Detwiler,deceased,left her surviving as her sole and only heirs at law,the
<br />following named persone,to -wit:

<br />Carrie D.Clarke adult daughter
<br />Grace V.Kuhns adult daughter
<br />That the said real property of said Mathilda A.Detwiler descended by law as follows: To Augustus.
<br />K.Detwiler,Carrie D.Clarke,and Grace V.Kuhns,each an undivided one -third interest.
