<br />BE IT REMEMBERED that on the 21st day of July, 1939, Ernest W. Augustind, administrator of the
<br />estate of Olive D.Augustine, deceased, filed-in this Court his final account as-such administrator
<br />and a petition praying that said account be allowed; for a decree of heirship, an order of distrib-
<br />ution, final settlement thereon and discharge.
<br />For these purposes the 16th day of August, 1939, at 10 o'clock A.M. at the County Court Room in
<br />said County was assigned as the time and place for hearing said petition, examining and Allowing
<br />said account; and it was ordered that notice of the pendency of said petition be given to all per-
<br />sons interested in said estate by publishing a notice of said order in the Grand Island Independent
<br />a legal newspaper printed in said county, for three weeks prior to said day of hearing; and it
<br />appears by proof on file that said notice was given as ordered by the Court and no objections have
<br />been filed to said report.
<br />Upon an examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST
<br />That Olive D.Augustine departed this life on the 5th day of July, 1938, in Lincoln, Nebraska, in-
<br />testate, and at the time of her death, she was a resident of Hall County, Nebraska.
<br />SECOND.
<br />That on the 24th day of February, 1939, Alice T.Augustine, mother of said deceased, filed in this
<br />court a petition praying for the appointment of Ernest W.Augustine as administrator of the estate
<br />of said deceased; and on the 24th day of February, 1939, an order of this court was made therein,
<br />assigning the 22nd day of Burch, 1939, at 10 o'clock A.M. at the County Court Room in said County,
<br />as the time and place for hearing said petition and ordering that notice of the pendency of said
<br />petition and the hearing thereon be given to all persons interested in said matter by publication
<br />of such notice in the Grand Island Independent, a legal newspaper printed in said County, for three
<br />successive weeks prior to said day of hearing, and it appears by proof on file that notice of said
<br />order was given as ordered by this Court.
<br />THIRD.
<br />The Court further finds that Ernest W.Augustine named in said petition was upon his giving a bond
<br />in the sum of $25,000.00, as ordered by this Court, appointed administrator as prayed; the Court
<br />further finds that the deceased at the time of her death, was an unmarried woman and that her
<br />father preceded her in death and that she left as her heir and only heir -at -law, Alice T.Augustine,
<br />her mother.
<br />FOURTH.
<br />That on the 22nd day of March, 1939, an order of this Court was made allowing creditors three months
<br />in which to file their claims against said estate and the administrator one year in which to settle
<br />said estate from the 19th day of April, 1939, and that a hearing on the claims filed against said
<br />estate would be held in the County Court Room of said County on July 20, 1939, at 9 o'clock A.M.,
<br />and further ordering that a notice of the same be published in the Grand Island Independent, a
<br />legal newspaper published and circulating in Hall County, Nebraska, three successive weeks prior to
<br />the 19th day of April, 1939, and it appears by proof on file that notice of said order was published
<br />as ordered by this Court.
<br />FIFTH.
<br />The Court further finds that on the 27th day of March, 1939, the said Ernest W.Augustine as admin-
