<br />Now, on this 9th day of August, 1939, this cause came on for hearing upon the petition of Elfrieda
<br />Bartenbach and George W.Bartenbach, petitioners herein, praying for settlement of the estate of said
<br />deceased, and determination of his heirs at law, and right of descent of said real estate, and the
<br />degree of kinship of said heirs at law, and it appearing from the proof on file herein that due
<br />and legal notice by publication for three consecutive weeks, as by law and the order of this Court
<br />required, has been given to all heirs at law, creditors, and other persons interested in said
<br />estate, of the filing of said petition and the time and place for hearing same, which time was
<br />more than thirty days and less than sixty days after the filing of said petition, and there being
<br />no objection thereto, the cause was duly submitted to the Court upon said petition and the evidence
<br />and the Court, being first duly advised in the premises, finds that the allegations in the petition
<br />are true, that said William A.Platt, also known as Wm.A.Platt, died intestate on or about the.5,rd
<br />day of December 1886, and that on the date of his death he was a bona fide resident of Hall County,
<br />state of Nebraska; that at the time of his death he was the owner of the said real estate herein
<br />described in Hall County, Nebraska; that more than two years have elapsed since his death, and
<br />that no application has been made in the state of Nebraska for the appointment of an administrator
<br />of said estate, and no administration has been had of said estate, in the state of Nebraska.
<br />The Court finds that said deceased left surviving hiii the following sole and only heirs at law:
<br />Mary E.Platt, widow,
<br />Margaret E.Conely, daughter,
<br />William H.Platt, son,
<br />Nathan Platt, son.
<br />The Court finds that said William A.Platt,.also known as Wm.A.Platt, died seized of the following
<br />described real estate:
<br />Lot Six (6) in Block Sixty -six (66) in the Original Town of Grand Island, in Hail County, state
<br />of Nebraska, -
<br />which said real estate did pass and descend, on the date of the death of said William A.Platt,
<br />also known as Wm.A.Platt, by operation of law, to Mary E.Platt, Margaret E.Conely, William H.Platt,
<br />and Nathan Platt,.- in.their respective shares as by law provided.
<br />The Court further finds that no petition or application has been filed in the state of Nebraska
<br />for the appointment of an administrator of the estate of said deceased, and that no administration
<br />has been had upon his estate in the state of Nebraska, and that more than two years have elapsed
<br />since his death, and that he died intestate, and that his funeral expenses have been paid, and that
<br />all the debts of said deceased, and his estate, have been paid, and are forever barred and precluded
<br />and that the costs of this proceeding have been paid.
<br />The Court finds that the petitioner herein Elfrieda Bartenbach, is the owner of a life estate, and
