<br />L I further expressly provide that in the event any beneficiary under this will sould object
<br />to its allowance and probate as and for my last will and testament, or should contest the allow-
<br />ance and probate of this will as my last will and testament, then and in that event any such bene-
<br />ficiary so objecting to the allowance and probate of this will as and for my last will and testa-
<br />ment, or contesting the allowance and probate of this will as and for my last will and testament,
<br />shall take nothing under this will, and shall take no part of my estate, and any provision made
<br />in this will in favor of any such beneficiary objecting to the allowance and probate of this will
<br />as and for my last will and testament, or contesting the allowance and probate of this will as
<br />and for my last will and testament, shall thereupom be revoked and held for naught, and the share
<br />of my estate which such objecting or contesting beneficiary would have taken under this will but
<br />for such objection or contest, shall pass, by absolute title, to the one of my two children,
<br />Catherine F.Dean or Daniel H.Fishburn, who does not object to or contest the allowance and probate
<br />of this instrument as and for my last will and testament.
<br />SEVENTH.
<br />I hereby revoke any and all former wills made by me.
<br />EIGHTH.
<br />I hereby nominate and appoint my said son, Daniel H.Fishburn, as Executor of this will.

<br />I, William H.Fishburn, widower, of Hall County, Nebraska, still being of sound mind and disposing
<br />memory, do make and publish this codicil to my last will and testament bearing date April 29,193Q,
<br />that is to say: FIRST.
<br />I hereby revoke the fourth paragraph of my last will and testament bearing date April 29, 1930, add
<br />in lieu thereof do now provide:
<br />I give and devise to my beloved son, Daniel H.Fishburn, the northeast quarter of Section Twenty -eight
<br />(28) in Township Eleven (11) North,Range Ten (10) West of the 6th P.M., in Hall County, Nebraska, to
<br />have-and to.hold the'same forever, charged, however, with the payment to, my said daught ,Catherine
<br />F.Dean, by my said son, Daniel H.Fishburn, of the sum of Five Hundred Dollars 0500.00.- payable with-
<br />in one year after my death. SECOND.
<br />As modified by this codicil, I hereby republish my said last will and testa went bearing date April
<br />29, 1930.

<br />I- hereby revoke the last three lines contained in paragraph numbered "First" of said codicil bearing
<br />date May 8, 1933, which said three lines reas as follows: "charged,however, with'the payment to'my
<br />said daughter, Catherine F.Dean, by my said son, Daniel H.Fishburn, of the sum of Five Hundred Dol-
<br />lars ($500.00_ payable within one year after my death," otherwise the said codicil bearing date
<br />May,8, 1933: to remain in full force and effect, it being my intention that my-son,;Daniel-H.Fish,-
<br />.burn, shall have the real estate described in said codicil dated May 8, 1933, free and clear from
<br />the said charge of five hundred dollars.
