<br />of said petition be given to all persons
<br />interested in said estate by publishing
<br />such notice of
<br />said order in The Grand Island Independent,
<br />a legal newspaper printed and published
<br />in said county,
<br />three successive weeks prior to said day 6f
<br />hearing; and it appears by proof on file
<br />that said notice
<br />was given as ordered by Court and that no
<br />objections thereto have been filed.
<br />Upon an examination of the records and the
<br />evidence in
<br />this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST:-
<br />That Augusta Bruchmann Beberniss departed this life on the 13th day of June, 1930, in Grand Island,
<br />Nebraska, testate, and at the time of her death she was a resident of Hall County, Nebraska,.and
<br />that the said deceased left a Last Will and Testament which was filed in this Court for probate on
<br />the 23rd day of June, 1930.
<br />SECOND:
<br />That John R.Thompson was nominated in said Last Will as Executor thereof, and that the following are
<br />the legatees, devisees and heirs -at -law named therein:
<br />Sven Peter Svensen, a brother, of Sweden
<br />Helen Svensen, a sister, of Philadelphia, Pennsylvania
<br />Johanna Esenberger, of Winthrop, Minnesota.
<br />Charlotte Svensen, a sister, of Sweden
<br />Karolina Ingelsson, also known as Karolina Ingelson, a niece,
<br />Anna Phlbson, a niece
<br />Johanna Larsson, a niece, and the following children of Sofia Evald, a niece, who died October 5,
<br />1907, to -wit:
<br />Ellen Maria J8nsson
<br />Selma Natalia Johansson
<br />Ernst Albin Evald
<br />Astrid Bernhardina Natalia Mellberg
<br />Johan Albert Evald
<br />Arvid Manstedt Evald
<br />Gustaf Adolf Evald, They all being the heirs of Anna Lisa Svensdotter, also known as Anna Lise
<br />Svensen, a deceased sister of said testatrix
<br />THIRD
<br />That on the 23rd day of June, 1930, Fred Beberniss, widower of said Augusta Bruchmann Beberniss,
<br />deceased, filed in this Court a petition for the probate of said Last Will and Testament and the
<br />appointment of ;-lerbert F.Mayer as Administrator With Will Annexed thereof, the said John R.Thompson
<br />named as Executor in said Will, having preceeded said Testatrix in death; and on the 23rd day of
<br />June, 1930, an order of this Court was made therein, assigning the 17th day of July, 1930, at 10
<br />o'clock A.M. at the County Court Room in said County as the time and place for hearing said petition
<br />and ordering that notice be given to all persons interested in said matter by publishing a copy
<br />of said order in The Grand Island Herald, a legal newspaper printed in said County, for three suc-
<br />cessive weeks prior to said day of hearing; and it appears by proof on file that notice of said
<br />order was given as ordered by this Court.
<br />FOURTH:
<br />The Court further finds that on the said 18th day of July, 1930, the said Last Will and Testament
<br />was duly proved, approved and allowed as the Last Will and Testament of Augusta Bruchmann Beberniss -
<br />deceased, the decree of probate was made thereon, and Herbert F.Mayer, named in said petition was,
<br />upon his giving bond in the sum of Five Thousand Dollars as ordered by this Court, appointed Admin-
<br />istrator With Will Annexed; the Court further finds that the deceased at the time of her death,
<br />was the wife of said Fred Beberniss, with whom she had entered into an anti- nuptiAl agreement
<br />whereby said Fred Beberniss waived any and all claim or right or interest in and to her estate
<br />and every part thereof and that she left the following heirs -at -law, to -wit:

<br />Johan Oskar Svensson
<br />Alfhilda Ottilia Svensson, heirs of Sven Peter Svensson
<br />Helen Svensen, a sister

<br />Herman Peterson, heirs of Johanna Esenberger, a sister,
