<br />In the Matter of the Estate
<br />DECREE.
<br />of Carrie Barton,Deceased.
<br />Now on this 23rd day of March,1939,this cause came on for hearing upon the petition of Ruth Gene-
<br />vieve Barton Haushahn praying for the settlement of said estate,for a determination of heirship
<br />and right of descent of the real estate belonging to Carrie Barton,deceased,and the degree of
<br />kinship of her heirs at law and for a decree settling said estate; And it appearing to the Court
<br />from the proofs on file that due and legal notice has been given for publication for three successive
<br />weeks,as by law and the order of this court provided,to all creditors,heire at law and other persons
<br />interested in said estate of the filing of said petition and of the time and place fixed for hear-
<br />ing on the same,and there being no objection thereto,this cause was duly submitted to the Court
<br />upon the petition and the evidence in support thereof,and the Court being duly advised in the
<br />premises,finds that the allegations in said petition are true ;that said petitioner,Ruth Genevieve
<br />Barton Haushahn,is the present owner of an interest in the real estate hereinafter described and
<br />is a competent and proper person to prosecute this proceeding;that the said Carrie Barton died
<br />intestate on March 3 ,1923; that at the time of her death,she was a resident and inhabitant of Henry
<br />County,Iowa;that she died seized as the owner in fee simple title of an undivided one -tenth interest
<br />In and to: the best Half of the Southwest Quarter of the Northeast Quarter (Wi EJN*) and the East
<br />Half of the Southwest Quarter (L*SEJ) of Section Twelve (12 ) in Township Eleven (11) , North,Range Ten
<br />(10),`West of the 6th P.M.in Hall County,Nebraska: that more than fifteen years have elapsed since
<br />her death; that no application has ever been made in the State of Nebraska for the appointment of
<br />w-iada migtratarrof her estate; that no petition has been filed for that purpose and no administration
<br />has been_had in the State of Nebraska upon her estate.
<br />The Court further finds that the said Carrie Barton left surviving her as her heirs at law and
<br />only heirs at law the following named persons: W.H.Barto n,her surviving husband,Ruth Genevieve
<br />Barton Haushahn,a daughter.
<br />The Court further finds that under the laws of the State of Nebraska in force at the date of the
<br />death of the said Carrie Barton,the real estate hereinbefore described passed and descended by
<br />absolute title to the said W.H.Barton and Ruth Genevieve Barton Haushahn,share and share alike.
<br />The Court further finds that'..:the funeral expenses of said deceased have been fully paid and that
<br />all debts of the deceased and of her estate,if any such exist,are forever barred and precluded
<br />and the costs of this proceeding have been paid.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED by the Court that the said Carrie Barton died intest-
<br />ate in Henry County, Iowa,on the 3dJof March,1923;that more than fifteen years have elapsed since
<br />the death of the said Carrie Barton;that no application for the appointment of an administrator
<br />of her estate has ever been made,nor has there ever been any administration upon her estate in the
<br />State of Nebraska;that said deceased died seised as the owner in fee simple title of the real estate
<br />hereinbefore described,situate in Hall County,Nebraska;that the petitioner herein is a opmpetent
<br />and qualified person to proeeoute this proceeding;that the deceased left surviving her as her heirs
<br />at law and only heirs at law,the following named persons:
<br />W.H.Barton.-her surviving husband,
<br />Ruth Genevieve Barton Haushahn,a daughter; and that upon the death of the said Carrie Barton,tbe
<br />real estate hereinbefore described passed and descended to the above named W.H.Barton and Ruth
<br />Genevieve Barton Haushahn,share and share alike.
<br />IT IS FURTHER ORDERED,Adjudged and Decreed by the Court that all debts of said deceased and of
<br />her estate,if any such there be,are forever barred and precluded;that the cost of this proceeding
<br />has been paid;and that further administration of said estate is hereby dispensed with;and said
