<br />of Section 3, in Township 10 North,Range 11 West, and the undivided one -half of the south half
<br />of the southwest quarter of Section 34, in Township 11 North,Range 11, all in Hall County, Nebraska
<br />without right, power, or authority in the said James McLellan to alienate Or in any manner incumber
<br />the northwest quarter.and the northwest quarter of the southeast quarter of said Section 13, in
<br />Township 11, North of Range 10 West, for the period of ten years after the death of the said
<br />William McLellan; 3.
<br />To Albert McLellan, the southeast quarter of Section 8, and the southwest quarter, of Section 9, all
<br />in Township 11 North,Range 10 nest of the 6th P.M., in Hall County, Nebraska, without right, power
<br />or authority in the said Albert McLellan to alienate or ih any manner incumber the same for the
<br />period of ten years after the death of the said William McLellan,
<br />To Rebecca McLellan Thomas, the southeast quarter of Section 9, and the southeast quarter of Section
<br />19, all in Township 11 North,Range 10 West, in Hall County, Nebraska, without right, power or auth-
<br />ority in the said Rebecca McLellan Thomas to alienate or in any manner incumber said real estate
<br />for the period of ten years after the death of said William McLellan,
<br />To Ada McLellan Layman (under the name of Ada McLellan Laymon) the west half of the northeast quarter
<br />and the northwest quarter of Section 27, in Township 11 North,Range 10 West, in Hall County, Nebraska,
<br />without right, power or authority in the said Ada McLellan Layman to alienate or in any manner in-
<br />cumber said real estate, for a period of ten years after the death of said William McLellan.
<br />To William McLellan (son of said William McLellan, deceased) the southeast quarter of Section 4,
<br />and the northwest quarter of Section 9, all in Township 11 North,Range 10 West, in Hall County,
<br />,Nebraska, without right, power or authority in the said William McLellan to alienate or in any
<br />;manner incumber said real estate for the period of ten years,after the death of said William Mc-
<br />Lellan, deceased; .
<br />To Jeanetta McLellan Leiser, the southwest quarter, the southeast quarter of the northwest quarter,
<br />and the northwest quarter of the.southeast quarter, of Section 16, and the south half of the south-
<br />east quarter of Section 17, all in Township 11 North,Range 10 West, in Hall County, Nebraska, with-
<br />out right, power or authority in the said Jeanetta McLellan Leiser to alienate or in any manner
<br />incumber said real estate for the period of ten years after the death of William McLellan, deceased.
<br />and that possession of said real estate has been given accordingly; that the following described
<br />real estate belonging to said estate was part of the residue, and under and by virtue of the terms
<br />and conditions of said last will and testament the following described real estate;

<br />North half of southeast quarter of Section 17, Township 11, Range 10,
<br />all in Hall County, Nebraska,
<br />West half of Section 17, Township 10, Range 13, in Buffalo County, Nebraska, and
<br />Northeast quarter and east half of northwest quarter of Section 5, Township 15, Range 17, Custer
<br />County, Nebraska, ,-;I-
<br />was devised to James McLellan, Albert McLellan, Rebecca McLellan Thomas, Ada McLellan Layman (as
<br />Ada McLellan Iaaymon), William McLellan, and Jeanetta McLellan Leiser, share and share alike.
<br />The Court further finds that the Executor has in his possession a promissory note dated January
<br />6, 1926, amount $13616.76, payable to William McLellan, signed by John McLellan, and holds as col -
<br />lateral to said note 100 shares of stock in Commercial State Bank, represented by Certificate No.
<br />172 for 50 shares, and Certificate No. 173 for 50 shares; that said John McLellan d:e.d, and his
<br />estate is insufficient to pay said note, and that said note and collateral was bequeathed under
<br />said last will and testament as part of the residuary estate to James McLellan, Albert McLellan,
<br />Rebecca McLellan Thomas, Ada McLellan Layman (as Ada McLellan Laymon), William McLellan, and
<br />Jeanetta McLellan Leiser, share and share alike, and that said Executor is hereby authorized and
<br />empowered and directed to assign said note and collateral to the said residuary legatees.
<br />The Court further finds that said report is true and correct in all things and ought to be, and is
<br />hereby, approved and allowed as and for the final report of James McLellan, executor, and he is
<br />hereby discharged and released from his bond.
