<br />Roeser as executrix under the Last Will and Testament of Oscar Roeser, Deceased, and she given
<br />one year from that date in which to settle said estate; that on said 22nd day of June, 1930,
<br />an order of this Court was made allowing creditors three months in which to file their claims against
<br />said estate and further ordering that a notice of said order be published in. the Grand Island In-
<br />dependent, a legal newspaper published and circulating in said Hall County,Nebraska, three success-
<br />ive weeks prior to the 20th-day of -July, 1938, and it appears by proof on file that notice of said
<br />order was published as ordered by this Court, in which order and notice a hearing on claims was
<br />APP,
<br />fixed on the 20th day of Oetober,Aat 9 o'clock A.M.
<br />-SIXTH.
<br />The Court further finds that on the 9th day of November, 1938,.the said Minna Roeser as executrix
<br />filed in Court her inventory of the property of said estate, and that according to said inventory
<br />the deceased died siezed and possessed of the following described property, to -wit:
<br />REAL ESTATE Lot Eight (S) in Roeser's Subdivision of the South Half of the Northwest quarter
<br />and Lots Two (2), Three (3), Four (4) and Five (5) in Section 16, Township 10,North,
<br />Range 9, West of the 6th P.M., according to the recorded plat thereof, save and
<br />excepting so much thereof as has heretofore been conveyed by deed to Gustave Baaseh
<br />which deed is recorded in Book 56 of Deeds at page 78; also save and excepting so
<br />much of said Lot 8 as has heretofore been conveyed by deed to Oswald Leschinsky,
<br />which deed is recorded in Book 63 of Deeds at page 449 in the office of the Register
<br />of Deeds in said Hall County, Nebraska.
<br />CHATTELS: An undivided one -third interest in the retail grocery business known as Oscar
<br />Roeser and Sons.
<br />SEVENTH.
<br />The Court further finds that according to the terms and provisions of said Last Will and Testament,
<br />said real estate passed, descended and was devised to said Minna M.Ree.ser for and during the term
<br />of her natural life and she to have full power and authority to sell and convey the same by ab-
<br />solute title, and upon her death, whatever remains thereof, descended and was devised to Emil F.
<br />Roeser, Oscar F.Roeser and Elsa Roeser Persson, children of said testator; said chattel property
<br />,was bequeathed unto Emil F.Roeser and Oscar F.Roeser upon their assuming and agreeing to pay all
<br />obligations of said firm of Oscar Roeser and Sons and the payment of a rental of $200.00 per month
<br />for the ground floor and basement of the store building now occupied by them on the Westerly two
<br />thirds of Lot 3 in Block 66 of the Original Town now City Of Grand Island, Nebraska, so long as they
<br />occupy the same for said business; the Court further finds that on the 14th day of March, A.D.,
<br />1939, said Minna M.Roeser, widow of said Oscar Roeser, deceased, filed in this Court, her accept-
<br />ance of the terms and provisions made for her in said Last Will and Testament.
<br />EIGHTH
<br />The Court further finds that on the 20th day of October, 1938, an order of this Court was made
<br />barring all claims not filed against said estate; that all just debts and claims against said
<br />estate and the cost of administration in said estate have been paid and that there remains no
<br />money in the hands of said executrix to be divided among the heirs, devisees and legatees of said
<br />Oscar-Roeser, deceased.
<br />NINTH.
<br />The Court further finds that after deducting from the assets of said estate, all debts, claims,
<br />costs of administration, other proper expenditures and the statutory exemptions allowed legatees
<br />and devisees in said estate, there is due and payable to the County Treasurer of Hall County,
<br />Nebraska, and to the United States of America, no inheritance tax herein whatsoever.
<br />IT IS THEREFORE ORDERED, ADJUDGED AYD DECREED BY THE COURT that the final report of said Minna
<br />M.Roeser, executrix in this estate, be and the same is hereby approved and allowed as such; fup-
<br />ther, that Minna M.Roeser, Elsa Roeser Persson, Emil F.Roeser and Oscar F.Roeser, are all and the
<br />only legatees and devisees of said deceased, and that the property described in paragraph Sixth
<br />hereof descends according to the terms and provisions of said Last Will and Testament and the
<br />finding of this Court in paragraph Seventh of this Decree; further that said executrix has fully
