<br />) FINAL DECREE.
<br />At a session of the County Court held in and for said County of Hall
<br />the 22nd day of March, 1939.

<br />BE IT REMEMBERED, that on the 25 day of February, 1939, Minna M.Aoeser, executrix under the Last
<br />Will and Testament of Oscar Roeser, deceased, filed in this Court her final account as such execu-
<br />trix and a petition praying that said account be allowed, for a decree of heirship, an order of
<br />distribution, a final settlement thereon and discharge.
<br />For these purposes the 22nd day of March, 1939, at 10 o'clock A.M. at the County Court Room in said
<br />County was assigned as the time and place for- hearing said petition, examining and allowing said
<br />account;: and it was ordered that notice of the pendency of said petition be given to all persons
<br />interested in said estate by publishing.a copy of said order in the Grand Island Independent, a
<br />legal newspaper printed and published in said county, three successive weeks prior to said day of
<br />hearing; and it appears by proof on file, that said notice was given as ordered by this Court and
<br />that no objections have been made to the allowance of said final accounting and report.
<br />Upon an examination of the records and the evidence in this matter and being duly advised in the
<br />premises, the Court finds-as follows:
<br />FIRST.
<br />That Oscar Roeser departed this life on the 13th day of June, 1936, in Hall County, Nebraska,
<br />testate, and at the time of his death he was a resident of Hall County, Nebraska, and that said
<br />deceased, left a Last Will and Testament which was duly filed in this Court for probate on the
<br />25th day of May, 1938.
<br />SECOND.
<br />That Minna M.Roeser was n6minated in said Last Will as executrix thereof, and that the following
<br />are the legatees, devisees and heirs -at -law named therein, to- wit: Elsa Roeser Pers$an, a daughter,
<br />Emil F.Roeser, a son, Oscar F.Roeser, a son and Mima M.Roeser, his *idov.
<br />THIRD.
<br />THAT ,6n the 25th day of May 1938, said Minna M.Roeser, widow of said Oscar Roeser, deceased, and
<br />executrix named in said Last Will, filed in this Court a petition for the probate of said Last Will
<br />and Testament and the appointment of said Minna M.Roeser as executrix thereof; that on the 25th
<br />day of May, 1938, an order of this Court was made therein, assigning the 18th day of June, 1939, at
<br />10 iolclock A.M. at the County Court Room in said County, as the time and place for hearing said
<br />petition, and ordering that notice be given to all persons interested in said matter by publishing
<br />a notice of said order in the Grand Island Independent, a legal newspaper printed in said County,
<br />for three successive weeks prior to said day of hearing, and it appears by proof on file that notice
<br />of said order was given as ordered by this Court.
<br />FOURTH.
<br />The Court further finds that on said 18th day of June, 1938, said Last Will and Testament was duly
<br />proved, approved and allowed as the Last Will and Testament of Oscar Roeser, deceased, a decree of
<br />probate was made thereon, and Minna M.Roeser, named therein, was upon her giving bond in the sum of
<br />$1,000.00 as ordered by this Court, appointed executrix thereof; the Court further finds that the
<br />deceased at the time of his death was a married man and that he left the following heirs -at -law;
<br />Minna M.Roeser, his widow, Elsa Roeser Persson, a daughter, Emil F.Roeser,.a son and Oscar F.Roeser,
<br />a son.
<br />FIFTH.
<br />That on the 22nd day of June, 1938, Letters Testamentry were issued by said Court to said Minna M.
