<br />The Court further finds that the said Jacob D.thode died seized of the following described real
<br />estate situated in the state of Nebraska, to wit:
<br />Lot 6, Block 130, Koenig & Wiebe's Addition to Grand Island, Hall County.
<br />IT IS, THEREFORE, ORDERED ATTD DECREED that the final account filed herein be and the same is hereby
<br />approved and confirmed; that the said Executor pay the said cash on hand and assign and deliver all
<br />of the other personal property aforesaid to the said Mary Thode, who is hereby awarded the title and
<br />control of all of said personal property for and during her natural life,,she to receive the rents,
<br />Issues and income therefrom and to use so much of the principal thereof as may be necessary for her
<br />proper support and maintenance during her natural life, and that all of such moneys and personal
<br />property remaining in her hands at the time of her death is hereby awarded and distributed to the
<br />legatees and devisees aforesaid in the proportions hereinbefore set forth, That upon payment as
<br />aforesaid, and the execution and delivery of assignments of said personal property, the said Executor
<br />be discharged from its trust.
<br />IT IS FURTHER ORDERED that the real estate hereinbefore described be and the same is hereby assigned
<br />and distributed to the said Mary Thode for and during her natural life under the terms of said
<br />last will and testament, with remainder to the devisees hereinbefore named in the proportions above
<br />set forth.

<br />transcript thereof, and of the whole of such original record; that said Court is a Court of Record
<br />having a seal, which seal is hereto attached; that said Court has no Clerk authorized to sign certi-

<br />I, Oscar Roeser, of Grand Island,Nebraska, being of ,sound mind and disposing memory, do make and
<br />publish this, my last will and testament, in the manner and form following, that is to say:
<br />FIRST.
<br />I direct that my just debts, and the expenses attending my burial, be first paid.
<br />SECOND.
<br />I give and bequeath unto my beloved daughter, Elsa Roeser Person, the sum of Two Thousand Dollars
<br />($2,000.00) to be paid out of my personal estate within two years After my death.
<br />THIRD.
<br />I give and bequeath to my beloved sons, Emil F.Roeser and Oscar F.Roeser, my undivided one -third
<br />interest in the partnership business of Oscar Roeser & Sons, said firm being composed of myself, .
<br />the said Emil F.Roeser and Oscar F.Roeser; they to assume and pay all obligations of said firm
<br />and to pay a rental of Two Hundred Dollars (6200.00) per month for the ground floor and basement
<br />of the store building now occupied by them on the westerly two- thirds of Lot Three (3) in Block
<br />Sixty -six (66) of the Original Town now City of Grand Island, Nebraska, so long as they occupy the
