<br />Now on this 22nd "day of March, 1939, this cause came on for hearing before the Court upon the final
<br />account of the First National Bank of Grand Ieland,Nebraska, executor under the last will and testa-
<br />ment of the said Jacob D.Thode, deceased, and its petition for distribution. Thereupon evidence was
<br />duly introduced, and the Court being fully advised in the premises finds that due and legal notice
<br />of the time and place of the hearing upon said final account and petition for distribution has been
<br />given to all persons interested in the said estate as provided by law. After a careful examination
<br />of the said final account the Court finds from the evidence that the same is true and correct in all
<br />respects and that the same should be approved and confirmed.
<br />The Court further finds that all proceedings required by law have been had for the proper filing,
<br />examination and allowance of claims against the said estate; that due notice has been given to all
<br />persons interested in said estate of the time and place of hearing upon said claims; that the said
<br />time has expired; that no claims whatever have been filed and that all debts, claims and demands
<br />against the said estate not heretofore paid, if any, should be and the same are hereby forever
<br />barred and foreclosed..
<br />The Court further further finds that the said Executor has on hands belonging to said estate the
<br />sum of $3331.97, in cash, and the following personal property, to -wit:
<br />Mortgage of John F.Reher, interest at 5% payable semi- annually, due Mar. 1, 1943, coverin 'the
<br />Northeast quarter of Section 22, and Southwest Quarter of Section 14, Township 16, Range 1,
<br />Laramie County, Wyoming - - - - - - - - - - -- - - - - - - - - - - - - - - $6,000.00
<br />Participation in mortgage of $8,000 of Sadie I.M cConnell, et al. covering 228 acres in Section
<br />7 and 18, Townshi 9, Range 18, Buffalo County, Nebraska, drawing interest at the rate of 5 *%
<br />due October 1, 190------------ - - - - -- - - - -- --- - - - - -- - -- 1387.50
<br />Mortgage of George Thode, drawing interest at 4 %, due August 6, 1936, covering Lots 1, 2 and 3
<br />Fair Acres Sub - Division, interest paid - - - - - - - - - - - - - - - - - - - - - - - - - 1500.00
<br />Note of George & Rose Thode, unsecured, due June 8, 1936, interest at 4% - - - - - - - - - 600.00

<br />Trust Certificate No. 12 interest in Auburn Manor, 2 /110the interest. Face Value - - - -- 1000.00
<br />Certificate Nol 1216 for 20 shares of Paidup Equitable Building & Loan Association Stock 2000.00
<br />Devon- Talman Building Trust No. 1, 2/'122 interest. Face Value $1000.00
<br />The Court further finds that by the terms of the last will and testament of the said Jacob D.
<br />Thode, heretofore admitted to probate herein, the said testator devised and bequeathed all of the
<br />real and personal property belonging to said estate, after the payment of indebtedness, to Mary
<br />Thode, his widow, for and during her natural life, she to receive the rents, issues and income
<br />therefrom and to use so much of the principal thereof as may be necessary for her proper support
<br />and maintenance during her natural life, and devised and bequeathed the remainder of said real
<br />and personal property after the expiration of said life estate to the following named persons,
<br />who are, with the said Mary Thode, his widow,
