<br />Now on this 15th day of March, 1939, this cause came on for hearing upon the Final Report of Sidney
<br />Binfield and Charles Miller, Executors of the Estate of Ernest E.Binfield, deceased, and upon the
<br />petition of said Executors for the allowance and approval of said report, the settlement of said
<br />estate, and discharge herein as Executors, and the Court, having examined the records and files
<br />herein, and being fully advised in the premises, finds that due and legal notice has been given
<br />to all persons of the time and place fixed by the Court for the hearing upon said Final Report,
<br />and no one appearing to object to said Final Report, and the Court, having examined the same, and
<br />-all preliminary reports, together with the vouchers on file, finds that said report is true and
<br />correct in all things and that the same ought to be approved and allowed as and for the Final Repoxt
<br />of said Executors, said Estate closed and said Executors discharged.
<br />The Court further -finds that the said Ernest E.Binfield departed this life on the 20th day of May
<br />1934, in Hastings, Adams County, Nebraska, and that at the time of his death he was a resident and
<br />inhabitant of Hall County, Nebraska, and left a Last Will and Testament, which was by the consid-
<br />eration of this Court, duly proven, allowed and admitted to probate on the 19th day of June, 1934;
<br />that in said Will he named, nominated and appointed Sidney Binfield and Charles Miller Executors
<br />and upon consideration by the Court the said Sidney Binfield and Charles Miller were duly appointed
<br />Executors of the Estate of Ernest E.Binfield, Deceased, and Letters Testamentary were duly issued
<br />by this Court to them.
<br />The Court further finds that due and legal notice has been given to all persons of the time and
<br />place fixed by the Court for filing claims against the estate of the deceased, and that the time
<br />so fixed has fully expired, and that all persons having claims against said estate, and not filed
<br />within the time limited by the Court, are forever barred and excluded from setting up or assert -
<br />ing any such claims against said estate.
<br />The Court further finds that the said Executors have paid the funeral expenses of said deceased,
<br />all debts against said estate and the costs of these proceedings, and are prepared to make dis-
<br />tribution of all remaining assets pursuant to the terms and provisions of the Last Will and Testa-
<br />ment of Ernest E.Binfield, Deceased.
<br />_The Court further finds that the estate of said deceased was not subject to an inheritance tax
<br />;under the Laws of the State of Nebraska, nor to a Federal Estate Tax under the laws of the United
<br />States.
<br />The Court further finds that the said Ernest E.Binfield died seized as the owner, by fee simple
<br />title, of the following described real estate all located in Hall County, Nebraska, to -wit:
<br />The South Half of the Northwest Quarter (SJNWJ) of Section Twenty -eight (28) Township Nine (9),
<br />North,Range Ten (10),West of the 6th P.M. containing SO acres;
<br />The South Half of the Northwest Quarter (S *NWJ) of Section Thirty (30),Township Nine (9),North,
<br />Range Ten (10) West of the 6th P.M., containing SO acres;
<br />The Southeast Quarter (SEi) of Section Twenty -four (24), Township Nine (9) North,Range Eleven (14)
<br />West of the 6th P.M., containing 160 acres;
<br />Lots One (1), Two (2), Three (3), and Four (4), Island, in Section Twelve (12), Township Nine (9),
<br />North,Range Eleven (11),Weet of the 6th P.M., containing 110 acres, more or less;
<br />that he was also the owner of a certain real estate mortgage for $4,700.00 executed by Robert Bin-
<br />field to the said Ernest E.Binfield, under date of September 17, 1931, and which mortgage was re-
<br />corded on September 26, 1931, in Book 67 of Mortgages at page 389 and conveying to the said Ernest
<br />E.Binfield by mortgage deed as security for said indebtedness, the following described real estate
<br />to -wit:
<br />The West Half of the Southwest Quarter (WJSWJ) of Section Twenty (20),Township Nine (9),North,
<br />Range Ten (10)v West of the 6th P.M., Hall County, Nebraska, containing 80 acres;
<br />that under the terms of the Last Will and Testament of the said Ernest E.Binfield, Deceased, said
<br />real estate mortgage as a part of the residuary estate of said deceased passed and descended to
<br />the residuary legatees hereinafter named, being children of the deceased; that the said Robert
