<br />they deem it advisable, to distribute any bonds or mortgages which I may have or which they acquire
<br />in the sale of my real estate, in kind to my said children, provided same can be equitable done
<br />thus avoiding the necessity of a sale of such securities. If such division of securities cannot
<br />be equitably made, ti -en said securities or mortgages shall be sold and proceeds divided as herein-
<br />above set
<br />forth.
<br />SEVENTH.
<br />In case of
<br />the death of any of my said
<br />children before my
<br />death, or before final settlement and dis-
<br />tribution
<br />of my estate, leaving issue
<br />or descendants them
<br />surviving, then in such case their share
<br />shall not
<br />lapse, but shall pass and be
<br />paid to such issue
<br />or descendants by right or representation,
<br />and in the
<br />event that any of my children aforesaid leave
<br />no issue, then his or her share shall pass
<br />or be paid
<br />to his or her survivor.
<br />EIGHTH
<br />I name, nominate and appoint Sidney Binfield, of Prosser, Nebraska, and Charles Miller, of Doniphan,
<br />Nebraska, or the survivor of them, Executors of this, my last Will and Testament, and Trustees for
<br />the purposes hereinabove set forth, and direct that they shall not be required to furnish bonds for
<br />the faithful discharge of their duties as such, and direct that they shall each receive as compen-
<br />sation therefor one - fourth of the rate provided by law,
<br />I also direct that A.J.Luebs, of Grand Island,Nebraska, be retained by them as attorney.
<br />IN TESTIMONY WHEREOF I have hereunto signed my name to this instrument consisting of three pages
<br />of typewritten matter, all of which I have identified with my signature thereon, on the 22nd day of
<br />March, 1932.

<br />28th day of May 1934, the instrument purporting to be the last will and testament of Ernest E.
<br />Binfield, deceased, was filed for probate in this Court. That on the 19th day of June 1934, said
<br />instrument to which this certificate is attached was duly proved, probated and allowed as the last
<br />will and testament of the real and personal estate of said Ernest E.Binfield, deceased, and the same
<br />was ordered to be recorded in the records of the Court aforesaid.
