<br />or either of them, shall have the power, by and with the consent, and approval of the court having
<br />jurisdiction of the probate of this will, to name a successor in trust, if for any reason it be-
<br />comes desirable or necessary so to do or in case a vacancy, by death or resignation, of either of
<br />said Trustees occurs without nominating a successor in trust, then the remaining Trustee can, with
<br />the consent and approval of said court, name a successor in trust hereunder, who shall have the
<br />same Dowers hereinbefore conferred upon the Trustees herein named. The Trustees herein named shall
<br />not be required to give bond as such Trustees, but any successor or successors to said Trustees
<br />shall enter into such bonds and with such surety or sureties as said court shall direct.
<br />FIFTH.
<br />I nominate and appoint my
<br />said son, Andrew Jacobsen, and my said daughter,
<br />Clara Jacobsen, as
<br />Executrices of this will,
<br />and request that they be not required to furnish
<br />surety upon their offi-
<br />cial bond as such. In the
<br />event of the death of either of said Executrices,
<br />herein named, prior
<br />to the time of my death,
<br />then the survivor of them to act as sole Executor
<br />hereunder.
<br />SIXTH.
<br />I hereby revoke any and all former wills made by me.

<br />Christian Jacobsen, deceased. )
<br />Now on this 11th day of March, 1939, this cause came on for hearing before the Court upon the final
<br />report of Andrew Jacobsen and Clara Jacobsen, Executor and Executrix of the estate of Christian
<br />Jacobsen, deceased, upon their supplemental final report and petition for distribution. Thereupon
<br />evidence was duly introduced, and the Court, being fully advised in the premises, finds that due
<br />and legal notice of the time and place for hearing upon said final reports and petition for dis-
<br />tribution has been given to all persons interested in said estate by publication as provided by
<br />law. The Court further finds from an inspection of the said reports and from the evidence duly
<br />introduced that they are true and correct and should be approved and confirmed by the Court. That
<br />all proceedings have been had that are required by law for the proper filing, examination and allow-
<br />ance of claims against the said estate; that due notice of the time and place for filing such claims
<br />has been given to all creditors and other Persons interested, by publication as required by law;
<br />that said time has fully elapsed and all claims, debts and demands not filed herein should be and
<br />they are hereby forever barred and foreclosed.
<br />The Court finds that all claims allowed against the said estate, together with funeral charges and
<br />expense of last sickness, costs and expenses of administering the said estate, inheritance and
<br />estate taxes, have been paid in full and that the said Executor and Executrix have on hand the sum
<br />-of $2199.43 for distribution, and have on hand all of the notes, mortgages, bonds and securitites
<br />described in the inventory herein.
