<br />That on the 5th day.of January, 1938, said August Niedfelt filed his
<br />IN THE COUNTY COURT OF MERRICK COUNTY, NEBRASKA.
<br />the probate df said Will and his appointment as executor, and on said
<br />date an order of this Court

<br />was made assigning the 25th day of January, 1938, at 10 o'clock A.M.

<br />DIETRICH NIEDFELT, deceased.
<br />that notice be given all
<br />BE IT REMEMBERED that on the 25th day of January, 1939, August Niedfelt, executor of the Estate
<br />persons interested in said matter by publishing a copy of said order
<br />of Dietrich Niedfelt, deceased, filed in this Court his Final Report as such executor with petition
<br />praying that said account be allowed, for decree of heirship, order of distribution, final settle-
<br />weeks prior to said day
<br />ment thereof and discharge; for those purposes the 14th day of February, 1939, at 10 o'clock A.M.
<br />of hearing, and it appears by proof on file that notice of said order
<br />in the County Court Room in said County was assigned as the time and place for hearing said petition,
<br />examining and allowing "said accounting, and it was ordered that notice of the pendency of said
<br />petition and hearing thereon be given to all persons interested therein by publishing such notice
<br />The Court further finds that no objections were filed to the probate
<br />In the Central City Republican, a legal weekly newspaper printed in said county, for three successive
<br />weeks prior to said day of hearing; and it appears by proof on file that said notice was given as
<br />was duly proved and allowed
<br />ordered by Court and no objections to said final report having been filed, upon an examination of
<br />as the Last Will of the said Dietrich Niedfelt, deceased, a decree of
<br />the record and the evidence herein and being fully advised in the premises, the Court finds as fol-
<br />lows: First
<br />$1500 as ordered by the Court,
<br />That Dietrich Niedfelt departed this life on the 6th day of December 1937, in said Merrick County,
<br />appointed executor thereof.
<br />testate, and at the time of his death, was a resident therein; that he left a Last Will which was
<br />filed in this Court for probate on the 5th day of January, 1938, and that said Dietrich Niedfelt
<br />was commonly known as Dick Niedfelt and also as Diedrich Niedfelt, and frequently did business under
<br />the named of Dick Niedfelt and also under the name of Diedrich Niedfelt.
<br />Second.
<br />That August Niedfelt was nominated in said Will as executor and that the following persons are the
<br />legatees, devisees and heirs -at --law named therein, to -wit: August Niedfelt, Dietrich Niedfelt, Oscar
<br />Niedfelt, Walter Niedfelt, Frieda Klenk, Louise Stobbe, Olga Tillman, Emma Moeller, Lena Stoffregen,
<br />Alvina Ewoldt, Anna Niedfelt and Alma Wegner.
<br />Third.
<br />That on the 5th day.of January, 1938, said August Niedfelt filed his
<br />petition in this Court for
<br />the probate df said Will and his appointment as executor, and on said
<br />date an order of this Court
<br />was made assigning the 25th day of January, 1938, at 10 o'clock A.M.
<br />in the County Court Room in
<br />this County, as the time and place for hearing said petition and ordering
<br />that notice be given all
<br />persons interested in said matter by publishing a copy of said order
<br />in the Central City Republican
<br />a legal newspaper printed and published in said county, for three successive
<br />weeks prior to said day
<br />of hearing, and it appears by proof on file that notice of said order
<br />was given as ordered.
<br />Fourth.
<br />The Court further finds that no objections were filed to the probate
<br />of said will and on said 25th
<br />day of January, 1938, hearing was held on said petition and said Will
<br />was duly proved and allowed
<br />as the Last Will of the said Dietrich Niedfelt, deceased, a decree of
<br />probate was made thereon and
<br />August Niedfelt named therein was, upon his giving bond in the sum of
<br />$1500 as ordered by the Court,
<br />appointed executor thereof.
<br />Fifth.
<br />The Court further finds that the deceased at the time of his death, was a widower, hips wife having
<br />predeceased him, and that he left the following heirs -at -law; August Niedfelt, Dietrich-Niedfelt,
<br />Oscar Niedfelt, Walter Niedfelt, Frieda Klenk, Louise Stobbe, Olga Tillman, Emma Moeller, Lena
<br />Stoffregen, Alvina Ewoldt, Anna Niedfelt and Alma Wegner, and that said Will was in words and figures
<br />as follows:
