<br />simple to the tracts of lard respectively devised to them, that is such of my children as survive
<br />me. And if my wife die before me, I give and bequeath the balance of the sale proceeds of all my
<br />personal property and any personal property, if any, remaining unsold, to my surviving children
<br />and the descendant or descendants of any deceased child by representation, equally,share and share
<br />alike.
<br />ITEM EIGHT.
<br />Should any of my children above named die before me leaving issue surviving at my death, the issue
<br />of any such deceased child of mine 4 shall stand in the place of the parent and take the share such
<br />deceased child of nine would have taken under this will, if such deceased child had survived me.
<br />Should any child or children of mine die before me leaving no issue surviving at my death, then
<br />the share that such deceased child or children of mine would have taken hereunder, shall go to
<br />and be divided equally share and share alike between my surviving children and the issue of any
<br />deceased child of mine, by representation.

<br />It is my desire that the lard devised to my children be kept in the Kwoldt family, if possible,
<br />and it is my wish that if arty child is obliged to sell the land devised to it, that the child
<br />should first offer it for sale to one or all of the other children.
<br />This provision is not compulsory, but I hope and trust my- children will respect my wishes in this
<br />regard.
<br />ITEM TEN.
<br />I nominate and appoint my wife, Laura Ewoldt, executrix of this will, if she survive me, and I
<br />direct that she be not required to give bond or surety as such executrix. Should my wife die
<br />before me, or decline to act, I nominate and appoint my son, Emil Ewoldt, as executor of this
<br />will and direct that he shall not be required to give bond or surety as such. I authorize my
<br />executrix or her successor to sell any or all of the personal property owned by me at my death at
<br />either public or private sale without any license or order from any court or judge.
<br />Item Eleven.
<br />I hereby revoke all former wills and testaments by me heretofore made.
<br />IN WITNESS WHEREOF, I have hereunto set my hand to this my last will and testament, in duplicate
<br />and subscribed my name on the margin of the first three pages hereof in Hall County, Nebraska,

<br />side only, signed by the testator, Bernhard Ewoldt, and on the margin of the first three pages
<br />whereof he has also signed his name, was by the said Bernhard Ewoldt signed, published and
