26- <br />No. 7 HALL COUNTY <br />are the legat4es, devisees and heirs -at -law named therein: Mary Schlagman, his widow, Leonhardt <br />Krebs and John Krebs, step -sons, Lena Krebs, a step- daughter, and Clara Dryer, a daughter. <br />Third. <br />That on the 22nd day of June, 1938, Mary Schlagman filed in this Court a petition for the probate <br />of said Last Will and Testament and the appointment of Mary Schlagman as executrix thereof; that <br />on the 6th day of July, 1938, an order of this Court was made therein, assigning the 3rd day of <br />August, 1938, at 10 o'clock A.M. at the County Court Room in said County, as the time and place <br />for hearing said petition, and ordering that notice of the pendency of said petition and the hear- <br />ing thereof, be given to all persons interested in said matter by publishing a copy of said order <br />In the Grand Island Independent, a legal newspaper printed in said County, for three successive <br />weeks prior to said day of hearing, and it appears by proof on file that notice of said order was <br />given as ordered by this Court. <br />Fourth. <br />The Court further finds that on said 3rd day of August, 1938, said Last Will and Testament was <br />duly proved, approved and allowed as the Last Will and Testament of Frank Schlagman, deceased, a <br />decree of probate was made thereon and Mary Schlagman named therein was, upon her giving bond in <br />the sum of $500.00, as ordered by this Court, appointed executrix thereof; the Court further finds <br />that the deceased, at the time of his death, was a married inan and that he left the following heirs - <br />at -law: Mary Schlagman, his widow, and Clara Dryer, his daughter; the Court further finds that said <br />Last Will and Testament was in words and figures following, to -wit: <br />THE LAST WILL OF FPANK SCHLAGMAN <br />I. Frank Schlagman, being of sound mind and memory, mindful, however, of the possibility of death, <br />make this my last will, hereby revoking all former wills by me made. <br />I direct that all my just debts and funeral expenses be paid out of my estate. � <br />Unto Leonhardt Krebs and John Krebs, my stepsons, I give One Hundred ($100.00) Dollars each and to <br />my stepdaughter Lena Krebs, of St. Joseph, Missouri, I also give One Hundred ($100.00) Dollars. <br />In three vent of the death of any of said stepchildren prior to my death, I direct that the money C� <br />hereby bequeathed to him or her, shall go to the surviving stepchildren in like parts. <br />Said legacies shall not be paid out of my personal property but shall constitute and I hereby make <br />s them liens upon my real estate until they have been paid. <br />I give and bequeath unto my wife Mary Schlagman, all my personal property, investments, money in �1 <br />°e <br />bank or dither funds, to her and to her heirs forever. <br />In addition thereto, I give unto my said wife Mary the use and income from my real estate and at <br />her death, I give and devise said real estate to my daughter Clara Dryer of St. Joseph, Missouri, <br />to her and to her heirs forever. In the event of the death of my said daughter Clara before my <br />deceased, I devise said real estate to the surviving children of my said daughter, share and share <br />alike, to them and to their heirs forever. <br />I hereby request the appointment of my said wife as executrix of this will and provide that she <br />need give no surety on her bond, and in the event that she predeceases me, then I request the <br />Court to appoint my daughter Clara Dryer as executrix. <br />I hereby request that the firm of Arthur C.Mayer and Herbert F.Mayer be entrusted with the probate <br />of this will and administration of my estate. <br />In Witness whereof I have executed this will at Grand Island,Nebraska, on the 12th day of October, <br />A.D., 1937, at my home and caused the same to be duly attested by competent witnesses. <br />Frank Schlagman, Testator. <br />We whose names are hereunto subscribed, hereby certify that on this 12th day of October, 1937, we <br />were requested by Frank Schlagman, the testator, to witness his execution of the foregoing will <br />which consists of tvro pages.
