<br />I, Edward Roberts, at this time being a resident of Hall County, Nebraska, being of sound and dis-
<br />posing mind and memory, do make and publish this my last will and testament.
<br />1.
<br />I first direct my executor hereinafter named to pay my just debts including my funeral expenses and
<br />expenses of last illness.
<br />Il.
<br />I devise and bequeath all of my interest in and to the following described real- estate, to -wit:
<br />One quarter section in Howard County. - Nebraska,
<br />Three quarter sections in Howard County, Nebraska,
<br />Two quarter sections in Hall County, Nebraska,
<br />One eighth section in Hall County, Nebraska.
<br />it being my intention to devise by this paragraph all of the right, title and interest I have in
<br />any real property situated in Hall and Howard County, Nebraska, to my brother Harvey Roberts and
<br />my sisters Margaret and Rose Roberts to have and to hold forever, share and share alike.

<br />All of my personal property, wherever situate, I devise and bequeath to Harvey Roberts, Margaret
<br />Roberts and Rose Roberts, share and share alike.

<br />The two sections of real estate and an undivided one third interest in another section of real
<br />estate, all of which is now owned by me and situated in Arthur County, Nebraska, (it is my inten-
<br />tion that the devise in this paragraph include all right title and interest I have in any land
<br />situated in Arthur County, Nebraska,) comprises part of a ranch, the remainder of said ranch being
<br />owned by my said two brothers Harvey, and Alvin. I realize that`the property owned by me, if sold.
<br />separately, would not bring a fair price and would also reduce the value and workability of the
<br />contiguous land owned by my said brothers; therefore, I hereby devise and bequeath my said land
<br />in Arthur County, Nebraska, to my two brrthers, Harvey and Alvin, to be held in trust by them until
<br />such time as the survivor of them dies or until such time as they both shall deem it advisable for
<br />the best interests of the beneficiaries of this trust to sell either the entire tract comprising the
<br />`ranch or that portion of said ranch comprising the corpus of this trust.
<br />Haid trust shall be for the use and benefit of Alvin Roberts, Lillian Kutcher, Rose Roberts, Mar -
<br />garet Roberts and Harvey Roberts, share and share alike, and upon the sale of said land, as provided
<br />for in this will, the proceeds of said sale shall be divided among Alvin Roberts, Lillian Kutcher,
<br />Rose Roberts, Margaret Roberts and Harvey Roberts share and share alike. If both of my said
<br />brothers, the trustees hereunder, shall die without said land having been sold the said land shall
<br />pass to Lillian Kutcher, Rose Roberts, Margaret Roberts and the issue, if any, of my brothers Alvin
<br />and Harvey, share and share alike, it being my intention that the said issue, if any, of my brothers
<br />Alvin and Harvey, shall take only the sh,a,re the father would have taken had the land been sold the
<br />last day of the Patherts lifetime.
<br />If any of my sisters shall die during the existence of this trust, her issue, if any, shall be
<br />entitled to her share of said trust. If any of the beneficiaries of said trust shall die during
