NI <br />D <br />THE AUGUSTINE CO. 19600.12 -96 .. <br />by publication of such notice in the Grand Island Independent, a legal newspaper printed in said <br />County, for three successive weeks prior to said day of hearing, and it appears by proof on file <br />that notice of said order was given as ordered by this Court. <br />Third. <br />The Court further finds that on said 25th day of June, 1935, a hearing was had on said petition <br />according to said order and notice and the Court found the allegations of said petition to be true; <br />that said Irving M.Augustine departed this life on May 10, 1935, being at the time of his death, <br />a resident and inhabitant of Hall County, Nebraska; that he died intestate and thereupon ordered <br />that Ernest W.Augustine be appointed administrator of said estate and Letters of Administration be <br />issued to him upon his filing bond in the sum of $10,000.00, which bond was duly furnished and <br />approved by the Court and on June 26, 1935, Letters of Administration were issued out of this Court <br />to said Ernest W.Augustine. <br />Fourth. <br />The Court further finds that the deceased at the time of his death, was a married man and that he <br />left the following heirs -at -law, to -wit: Alice T.Augustino, his widow, and Ernest W.Augustine, <br />Olive D.Augustine, Howard M.Augustine, and Irving D.Augustine, his children, all over the age of <br />21 years. <br />Fifth. <br />That bn the 26th day of June, 1935, an order of this Court was made allowing creditors three months <br />In which to file their claims against said estate from the 23rd day of July, 19352 and further <br />ordering that notice of same be published in the Grand Island Independent, a legal newspaper pub- <br />lished and circulating in Hall County, Nebraska, three successive weeks prior to the 23rd day of <br />July, 1935, and it appears by proof on file that notice of said order was published as ordered by <br />this Court. <br />Sixth. <br />The Court further finds that on the 11th day of May, 1936, the said administrator filed in Court <br />his inventory of the property of said estate and that according to said inventory the deceased <br />died seized and possessed of the following described real estate, to -wit: <br />Lot Six (6) in Block Twelve (12) of Kernohan and Decker's Addition to the City of Grand Island, <br />Nebraska, and the <br />Easterly one -third (E.1 /3) of Lot Seven (7) and all of Lot Eight (8) in Block Sixty -seven (67) of <br />the Original Town now Uity of Grand Island,Nebraska. <br />in addition to chattel property in said inventory set forth. <br />Seventh. <br />The Court further finds that on the 25th day of June, 1935, William P.Mullen was duly appointed <br />appraiser for inheritance tax purposes of this estate and on the 3rd day of June, 1936, filed his <br />report herein showing said estate to be subject to the payment of inheritance tax and on June 3, <br />1936, an order of this Court was entered assessing inheritance tax against this estate in favor of <br />the County Treasurer of Hall County, Nebraska in the sum of $449.32, which inheritance tax has been <br />paid by the administrator in full. <br />E ighth. <br />The Court further finds that all inheritance tax due the United States of America against this <br />estate has been paid in full by said administrator and that all debts and claims against said estate <br />and costs of administration in said estate have been paid by said administrator and.that - there <br />remains no further funds in the hands of said administrator at this time. <br />Ninth. <br />The Court further finds that according to law, the property of this estate descends unto the follow- <br />ing persons: An undivided 2/6 interest to Alice T.Augustine, an undivided 1/6 interest to each of <br />the following: Ernest W.Augustine, Olive D.Augustine, Howard M.Augustine and Irving D.Augustine, <br />and that the real estate hereinbefore described so descended upon the death of the said Irving M. <br />1 <br />1 <br />1 <br />1 <br />1 <br />
