<br />Seventh.
<br />The Court further finds that according to the terms and provisions of said Will, all of said
<br />personal property was bequeathed to Minnie Leschinsky, widow of the deceased, to her and to her
<br />assigns, forever, and to be used as will best suit her.
<br />The Court further finds that all of said real estate was devised to the said Minnie Leschinsky for
<br />the term of her natural life in lieu of her statutory rights in said estate.
<br />The Court further finds that the said Minnie Leschinsky is granted the power to sell all of said
<br />real estate or so much thereof as is desired by her so to do on such terms and at such prices as
<br />to her may seem right and that such sale or sales may bd consumated without obtaining an order from
<br />any Court or Judge for permission or for license to sell the same and that the consent, permission
<br />or approval of any person need not be obtained when said right is exercised by her under this power
<br />and that the proceeds from such sale or sales shall not be impounded or deemed trust funds for any
<br />person whatever but shall become the property of the said Minnie Leschinsky solely to be used or
<br />disposed of either during her lifetime or by testamentary disposition, whichever she may see fit
<br />to do.
<br />The Court further finds that the use, income and profits from so much of said real estate as may
<br />be undisposed of at the time of the death of the said Minnie Leschinsky, either by gift, sale or
<br />testamentry disposition, shall go in equal parts to Mrs. Anna Lumbard and Miss Elizabeth Doll, share
<br />and share alike, and to the survivor of them and that the fee of such real estate undisposed of at
<br />the time of the death of the said Minnie Leschinsky shall descend to Herbert F.Mayer, to be held
<br />by him as Trustee only, and by him shall be sold after the decease of the said Minnie Leschinsky,
<br />the said Anna Lumbard and the said Elizabeth Doll and only in the-event that the said Minnie Les-
<br />chinsky has not exercised the power granting her the right to sell said real estate, or any part
<br />thereof, and further on condition that the said Minnie Leschinsky, either by gift, sale or testa -
<br />mentry disposition has not disposed of, granted, conveyed or devised said premises in whole or
<br />in part, such sale to be under such terms and for such prices as to the said Trustee may be just
<br />and equitable within a reasonable time. The net proceeds of said sale to be divided by said
<br />Trustee as follows: An undivided one -third (113) to Stanley Lumbard, Carl Lumbard, Lawrence Lum-
<br />bard and Gerald Lumbard, share and share alike and to their respective heirs; and undivided one-
<br />.fifteenth (1/15) t:o those children of Testator's cousin Hans Leschinsky who are living at the time
<br />of the death of the last survivor of said Testator's wife, Anna Lumbard and Elizabeth Doll; an
<br />undivided two- fifteenths (2/15) to the children of testator's deceased brother Max, nemely: Fritz
<br />Leschinsky, Dr. George Leschinsky and Anna Oltmann, share and share alike and to their respective
<br />heirs; an undivided one - fifteenth (1/15) to the children of testator's cousin Walter Leschinsky,
<br />namely: Margaurite Leschinsky and Maxine Leschinsky, share and share alike and to their respective
<br />heirs; an undivided two - fifteenths (2/15) to Ilse Wolf and Carl Heinz Leschinsky, children of tes-
<br />tator's deceased brother Carl Leschinsky, share and share alike and to their respective heirs; an
<br />undivided two - fifteenths (2/15) to testator's h&lf- sister Anna Klann and to her heirs; a one -fif-
<br />teenth (1/15) to Bertha Pruezeit, Anna Leschinsky, Ida Leschinsky and Bruno Leschinsky, share and
<br />share alike and to their respective heirs, they being children of testator's deceased uncle Fer-
<br />dinand Leschinsky; a one - fifteenth (1/15) to Lydia Ebel, and to her heirs, she being testator's
<br />niece.
