I I � I No. 7 HALL COUNTY <br />Fourth. <br />240 <br />The Court further finds that on April 16, 1934, objections were filed by August Muller and Wilhel- <br />mina Voss to the probate of said will and at a hearing held on said petition and said objections by <br />said Court on May 12 1934, said Last Will and Testament was duly proved, approved and allowed as the <br />Last Will and Testament of Christian Muller, deceased, a decree of probate was made thereon, and <br />Louie Muller named therein was, upon his giving bond in the sum of $1,000.00, as ordered by this <br />Court, appointed executor thereof; the Court further finds that the deceased at the time of his <br />death was a married man and that he left the following heirs -at -law: Bertha Muller, his widow, <br />Edward Muller, a son, August Muller, a son, Louie Muller, a son, Agnes Winter, a daughter, Bertha <br />Stelk, a daughter, Louisa Lorenzen, a daughter, Wilhelmina Voss, a daughter, and Hilda Bartelt, a <br />daughter; that said Last Will and Testament was in words and figures as follows: <br />LAST STILL OF CHRISTIAN MULLER OF HALL COUNTY, NEBRASKA. <br />IN THE NAME OF GOD, kREN: <br />I, Christian Muller, also known as Chris Mueller, of Hall County, Nebraska, being of sound mind <br />and memory, and considering the uncertainties of this mortal life, do hereby make, publish and <br />declare this my last will and testament, in words and figures following, to -wit: <br />1. <br />??nto my beloved wife, Bertha Muller, I give, devise and bequeath all of my property, both real and <br />personal, and wheresoever situated, to have and to hold for and during her natural life, with the <br />proviso that should the income from my real estate not be sufficient to maintain my wife in the <br />manner she is accustomed to, that then she may dispose of any of my real estate without first <br />obtaining an order or license from any Court or Judge and use the proceeds for her supnort and <br />maintenance. <br />2. <br />Unto my beloved son Edward Muller, I give and devise the Northwest quarter (NWJ) of Section Twenty - <br />seven (27), Township Thirteen (13) North, Range Nine (9),West of the 6th P.M. Howard County, Nebraska, <br />subject to the life estate hereinbefore given my wife, to have and to hold to him and his heirs <br />forever, subject, however, to a charge of Seven'Hundred Dollars ($700.00) in favor of my beloved <br />son August Muller, which charge is to be paid within five years after the death of the survivor of <br />myself and wife, and is to draw interest at the rate of 5 percent per annum from the date six months <br />after the death of the survivor of myself and wife until paid and is to be and remain a charge against <br />said land until paid. <br />In addition to the above, I give, and devise to my beloved son Edward Muller, the following described <br />tract of land, to -wit: <br />Commencing at the northeast corner of the southeast quarter (NE of SE4) of Section Ten (10),Township <br />Twelve (12) North, Range Nine (9),West of 6 P.I., Hall County, Nebraska, and running thence west <br />three hundred feet (300, thence south at right angles approximately seventy -five (75') to the north <br />bank of Prairie.Creek, thence in a southeasterly direction along the north bank of Prairie Creek to <br />the point where Prairie Creek intersects the section road, thence north along the section road <br />approximately three hundred feet (3001) to the.place of beginning, to <br />to have and to hold for and during hi., natural life, subject, however, to the estate hereinbefore <br />granted my wife. The tract herein described is improved with a house, barn, chicken house and shed. <br />Should my son Edward desire to move the buildings to the property located in Howard County herein- <br />before devised to him, he may do so and in such event the buildings shall be his absolute property. <br />My said son Edward may also, if he so desires, sell said buildings to my son Louie but shall not <br />demand more than Twelve Hundred Dollars ($1200.00) for'the same. Subject to the right to move said <br />buildings to the land in Howard County and subject to the right given to sell the same to my son <br />Louie, my said son Edward shall have no more than the life use of the buildings and the ground <br />lest described on which the same are situated. <br />3. <br />Unto my beloved son Louie Muller, I give and devise the Southeast quarter (SE-1) of Section Ten (10) <br />
