<br />Is true and correct in all things and that the same ought to be apF ;roved and allowed as and for
<br />the Final Report of said Executor, said estate settled and closed and said Executor discharged.
<br />The Count further finds that the said Mary Ziller departed this life on the 19th day of May, 1938,
<br />and at the time of her death she was a resident and inhabitant of Hall County, Nebraska, and left
<br />a Last Will and Testament and two Codicils thereto which were by the consideration of this court
<br />duly proven, allowed and admitted to probate on the 17th day of June, 1938; that A.J.Luebs, the
<br />person nominated as Executor in said Will was qualified and letters testamentary were duly issued
<br />by this Court to the said A.J.Luebs of the estate of Hilary Ziller, Deceased.
<br />The Court further finds that due and legal notice has been given to all persons of the time and
<br />place fixed by the Court for filing claims against the estate of Mary Ziller, Deceased, and that
<br />the time so fixed has fully expired and that all persons having claims against said estate and not
<br />filed within the time limited by the Court are forever barred and excluded from setting up or assert-
<br />ing any such claims against said estate.
<br />The Court further finds that said Executor has paid. all funeral expenses of said deceased, all
<br />debts against said estate, and the costs of these proceedings, has purchased a suitable monument
<br />as directed in the Will and that all specific bequests made either in the Will or the Codicils have
<br />been fulfilled and tl -at all remaining personal estate as shown by his final report-passes to Mary
<br />Zoch of Clintonville, Wisconsin.
<br />The Court further finds that the estate of said deceased is subject to an inheritance tax under
<br />the laws of the State of Nebraska, in the sum of $13.55, wiich amount has been paid, and that said
<br />estate is not subject to a Federal Estate Tax under the Laws of the United States.
<br />The Court further finds that the said Mary Ziller died seized as the owner by fee simple title of
<br />the following described real estate, to -wit:
<br />An undivided one -half interest in the Southeast Quarter (SEI) of Section Twenty -six (26), `1`ownship
<br />Sixteen (16), North, Range Eleven (11), West of the 6th P.M., Howard County, Nebraska;
<br />The North Half of the Southeast Quarter (N2SE4),and the Southeast Quarter of the Southeast Quarter
<br />(SEISED of Section Thirty -six (36), Township Ten (10),North,Range Nine (9), West of the 6th P.M.,
<br />Hall. County, Febraska;
<br />An undivided one -half interest in Lot Eight (8) Block Eleven (11) Rollins Addition to the City
<br />of Grand. I,oland,Hall County, Nebraska.
<br />The Court further finds that under the terms and provisions of the Last Will and Testament and
<br />Codicils of said Lary Ziller, Deceased, the real-estate hereinbefore described passed and descended
<br />to Mary Zoch, of Clintonville, Wisconsin, only surviving daughter of the deceased, by absolute title
<br />to have and to hold the same forever.
<br />IT IS THEREFORE ORDERED, ADJUDGED AMID DECREED BY THE COURT that the Final Report of the said A.J.
<br />Luebs, Executor of said Estate of Mary Ziller, Deceased, be, and the same hereby is in all thin=s
<br />approved and allowed as and for the Final Report of said Executor and said estate is hereby settled
<br />and closed and said Executor discharged.
<br />IT IS FURTHER ORDERED, ADJUDGED AP.D DECREED BY THE COURT that all persons having claims against
<br />said estate, if any such there be, are forever barred, enjoined and excluded from setting up or
<br />asserting any such claims against said estate.
<br />IT IS FTTTITHER ORDERED; ADJUDGED AND DECREED BY THE COURT that the distribution of the personal
<br />property remaining in the possession of the Executor as set forth in his Final Report, be approved,
<br />and that under the terms and provisions of the Last Will and Testament and Codicils thereto of said
<br />Mary Ziller Deceased, the real estate hereinabove described passed and descended to Mary Zoch by
<br />absolute title, to have and to held the same forever. Paul N.Kirk
