<br />of FINAL DECREE
<br />Preston Hinkson, Deceased. )
<br />Now on this 23rd day of November, 1938, at a regular session of the County Court in and for Hall
<br />County, Nebraska, this cause came on to be heard upon the Final Report of Edward Huwaldt and Charles
<br />Hinkson, Executors of the last Will and Testament of Preston Hinkson, deceased, and due notice
<br />having been given of this hearing, as provided by law, the court, after due consideration thereof
<br />and after having examined the records, files, receipts and statements in this case, finds that
<br />said Executors have faithfully performed their duties and have accounted for all money received and
<br />all money disbursed, and their accounts should be allowed and settled, and said executors discharged
<br />and their bonds released.
<br />The Court further finds that prior to -the death of the said Preston Hinkson, he had executed a deed
<br />in trust, whereby he appointed Everett Hinkson and Edward Huwaldt as Trustees, in the event of his
<br />death, to handle, control and operate the business in which he was engaged, with full authority;
<br />that prior thereto the said Preston Hinkson and Charles Hinkson were partners engaged in business
<br />in Nebraska, Texas, Arizona and New Mexico; that by the terms of said trust agreement, the said
<br />trustees, Everett Hinkson and Charles Hinkson, were given full authority to conduct the said part -
<br />hership business until such time as in their opinion the same may be settled and disposed of to the
<br />best advantage of said partnership; that they were authorized to borrow money, to execute mortgages,
<br />to convey real estate, and in general, do and perform all the acts in reference to the ha ni.ling of
<br />said property that Preston Hinkson could have done, were he living.
<br />The court further finds that all personal property belonging to said estate, after the payment of
<br />debts, has been turned over to Everett Hinkson and Edward Huwaldt, as Trustees, for the estate of
<br />Preston Hinkson, deceased, and that all of said property has been duly and legally accounted for.
<br />The court further finds that on the 11th day of February, 1935, the said Preston Hinkson executed
<br />a last Will and Testament, which has been duly admitted to probate in this court, and that no pro-
<br />ceedings in error or appeal has been taken therefrom, -and the said last Will and Testament has been
<br />duly adjudged and found by this Court to be the last Will and Testament of Preston Hinkson, deceased,
<br />and is in words and figures as follows, to -wit;

<br />"I, Preston Hinkson, of Cairo, Hall County, Nebraska, being of sound mind and memory, but not un-
<br />mindful of the possibility of death, do hereby make, publish and declare this, my last will and
<br />Testament, hereby revolting any and all former wills by me made;
<br />1.
<br />In the event of my death, I direct that all my ,just debts and funeral expenses be first paid out
<br />of my estate.
<br />11.
<br />I give, devise and bequeath all the rest and residue of my property unto my wife and children in
<br />accordance with the laws of the State of Nebraska, the descent and distribution of said estate
<br />being as provided by the laws of the State of Nebraska.

<br />"In the event of my death, I hereby nominate, constitute and request the Court to appoint my brother,
<br />Charles Hinkson, now residing at Muleshoe, Texas, but whose permanent home he considers to be in
<br />Hall County, Nebraska, and Mr. 'Edward Huwaldt, of Grand Island,Hall County, Nebraska, as Executors
<br />of this, my last Will and Testament, and I further authorize them as executors of my estate to sell
<br />and convey any real estate which I may own, to execute proper deeds therefor, the same as I could
<br />do in my own proper person, and to sell, mortgage or transfer the same, the same as I could do.
<br />IN WITNESS WHEREOF, I have executed the foregoing will in the office of Messrs. Prince & Prince,
<br />Grand Island,Nebraska, on this 11th day of February, 1938, and. caused the same to be duly attested
<br />by two competent witnesses."
