21- <br />THE AUGUSTINE CO. 18600 -12.86 <br />The Court further finds the said Clisba A. Ellis departed this life on July 17, 1937, and that at <br />the time of his death he was a resident and inhabitant of Hall County, Nebraska; that the said Clisba <br />A.Ellis died intestate; that a petition for Letters of Administration was filed on the 27th day of <br />July 1937, asking that said estate be admitted to probate and that Letters of Administration be <br />issued to Oscar Searson of Alda, Nebraska, upon the goods, chattels, real estate, rights and credits <br />of the said Clisba A.Ellis, Deceased, and that upon a hearing held upon said petition after notice <br />was duly given to all persons interested in said estate, said estate was admitted to probate on the <br />26th day of August, 1937, and Letters of Administration were duly issued by this Court to the said <br />Oscar Searson on the estate of Clisba A.Ellis, deceased, <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed by the Court for filing claims against the estate of said deceased, and that the time <br />so fixed has fully expired and that all persons having claims against said estate.and not filed <br />within the time limited by the Court, are forever barred and excluded from setting up or asserting <br />any such claim against said estate; that all claims filed against said estate and the costs of <br />these proceedings are paid. <br />The Court further finds that the estate of the deceased is not subject to an inheritance tax under <br />the laws of the State of Nebraska, nor to a. Federal Estate Tax under the laws of the United States. <br />The Court further finds that the said Clisba A.Ellis was possessed of the following described real <br />estate in the State of Nebraska at the time of his death, viz: <br />Lots Six (6) and Seven (7) in Block Three (3)1 Clarkson's Addition to the Village of Alda, Hall <br />County, Nebraska; <br />An undivided one -sixth interest in the Northwest Quarter (NW4) of Section Twenty -eight (28) , town - <br />ship Eleven (11),North,Range Ten (10),West of the 6th P.M., Hall County, Nebraska; <br />An undivided 1 /21st interest in the South Half of the Southwest Quarter (S'SWI) of Section Twenty - <br />(NW4) of Section Twenty -nine (29),Township Eleven (11-),North, <br />one (21) and the Northwest Quarter <br />Range Ten (10),West of the 6th P.M., Hall County, Nebraska. <br />The Court further finds that the said Clisba A.Ellis left surviving him at the time of his death <br />the following heirs -at -law and only heirs -at -law, all of whom were at the time of legal age, viz: <br />Robert R.Ellis, of Alda, Nebraska, a son, Nettie Knight of Argonia,Kaneas, a daughter, Margaret <br />Searson of Alda, Nebraska, a daughter, Maud Chapman of Filer, Idaho, a daughter, and Bessie Kelly <br />of Alda, Nebraska, a daughter; that one daughter, May Gaddis, preceded him in death, leaving no <br />children surviving her. <br />The Court further finds that the aforesaid real estate passed and descended upon the death of <br />Clisba A.Ellis to Robert R.Ellis, Nettie Knight, Margaret Searson, Maud Chapman, and Bessie Kelly, <br />and to each of them an undivided one -fifth therein, share and share alike, to have and to hold the <br />same forever. <br />IT IS THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the Final Report of the said Oscar <br />Searson, Administrator of the estate of Clisba A.Ellis, deceased, be, and the same is in all things <br />approved and allowed as and for the Final Report of said Administrator and that said estate is <br />hereby settled and closed and said Administrator discharged, and the sureties on his bond as such <br />released from further liabilitT,. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims against <br />said estate, if any such there be, are forever barred, enjoined and excluded from setting up or <br />asserting any such claim against said estate. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the real estate hereinabove described <br />passed and descended to Robert R.Ellis, Nettie Knight, Margaret Searson, Maud Chapman, and Bessie <br />Kelly,., and to each an undivided one -fifth interest therein, share and share alike, to have and to <br />hold the same forever. <br />Paul N.Kirk <br />County Judge. <br />
