<br />at law, and for a decree settling said estate.
<br />AND, it appearing to the Court from the proofs on file that due and legal notice has been given by
<br />publication for three successive weeks, as by law and the order of this C ourt provided, to all
<br />creditors, heirs at law, and other persons interested in said estate, of the filing of said petition
<br />and of the time and place fixed for the hearing thereon, and there being no objections thereto, the
<br />application was duly submitted to the Court upon the petition and the evidence in support thereof,
<br />and the Court being duly advised in the premises, finds that the allegations in said petition are
<br />true, that the said Delia R.Dickinson died intestate in Hall County, Nebraska, on the 3rd day of
<br />February, 1998, being at the,time of her death, a resident and inhabitant of Hall County,Nebraska,
<br />that she died seized as the owner in fee simple title of the following described property,to -wit:
<br />Lot Six (6) in Block Seven (7) in MacColl & Leflang's Addition to the town of Wood River, Hall
<br />County, Nebraska;
<br />that more than forty years have elapsed since her death; that no application has been made in the
<br />state of Nebraska, for the appointment of an administrator, and no administration has been had
<br />upon the estate of the said Delia R.Dickinson.
<br />The Court finds that the petitioner, Boyd W.Heeren, is the owner of Lot Six (6) in Block Seven (7)
<br />in MacColl & Leflang's Addition to the town of Wood River, Hall County, Nebraska, and is a proper
<br />person to file this application.
<br />The Court further finds that the said Delia R.Dickinson left surviving her as her heirs at law,
<br />her father, Nathaniel P.Dickinson, her mother, Harriet E.Dickinson, and her sisters, Ada C.J.Dick-
<br />inson and Ellen F.Dickinson; and that under the laws of the state of Nebraska, in force at the
<br />date of the death of the said Delia R.Dickinson, the real estate hereinbefore described passed
<br />and descended to said heirs in absolute title.
<br />The Court finds that the funeral expenses of said deceased have been paid, and that all debts of
<br />the deceased, if any such existed, were forever barred and precluded, and. that the costs of these
<br />proceedings have been paid.
<br />The Court finds that the said Delia R.Dickinson did not occupy the above premises as a homestead
<br />at the time of her death, and that sa d estate is not subject to inheritance tax under the laws
<br />of the state of Nebraska.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the said Delia R.Dickinson died
<br />intestate in Hall County, Nebraska, on the 3rd day of February, 1998; that more than forty years
<br />have elapsed since the death of the said Delia R.Dickinson; that no application for appointment of
<br />administrator of said estate has been made, nor has there been any administration upon said estate
<br />in the state of Nebraska; that said d ceased died seized as the owner in fee simple title to Lot
<br />Six (6) in Block Seven (7) in MacColl & Leflang's Addition to the town of Wood River, Hall County,
<br />Nebraska; that the petitioner is a co petent and qualified person to prosecute this petition; that
<br />the said deceased left surviving her
<br />her father, Harriet E.Dickinson, her
<br />sisters; and that upon the death of
<br />descended in absolute title to said
<br />IT IS FURTHER ORDERED, ADJUDGED AND
<br />her heirs and only heirs at law, Nathaniel P.Dickinson,
<br />Cher, and Ada C.J.Dickinson and Ellen F.Dickinson, her
<br />e said Delia R.Dickinson, the said real estate passed and
<br />irs.
<br />CREED BY THE COURT that all debts of said deceased and of
<br />her estate, if any such there be, are forever barred and precluded, and that further administration
<br />of said estate is hereby dispensed with, and said estate is finally settled and closed.
