<br />MATTER OF THE ESTATE OF MARIE WILKE, DECEASED, with the original record thereof, now remaining in
<br />said Court, that the same is a correct transcript thereof, and of the whole of such original record;
<br />that said Court is a Court of Record having a seal, which seal is hereto attached; that said Court
<br />has no Clerk authorized to sign certificates in his own name, and that I am the legal custodian

<br />IN THE COUNTY COURT OF ADAMS COUNTY, NEBRASKA

<br />On this 24th day of February, 1937, at 10 :00 o'clock A.M.,• being the date to which this matter
<br />was duly continued after being originally set for February 16, 1937, at 10 :00 o'clock A.M., this
<br />matter comes on for hearing upon the final account of the Executor and for final settlement of-the
<br />Estate and discharge of the Executor. The whole matter coming on before the Court for final deter-
<br />mination, the Court being fully advised and informed in the premises finds:
<br />1. That due and legal notice of the time and place for this hearing has been given to all persons
<br />interested, by publication as provided by law, and proof of said publication is on file herein.
<br />2. That William D.Devereaux, departed this life testate on January 13, 1936, being at the time of
<br />his death a resident and inhabitant of Adams County, Nebraska, and the owner of real and. personal
<br />property located therein.
<br />3. That on January 27, 1936, an instrument purporting to be the Last Will and Testament of said
<br />deceased was filed in this Court, and thereafter on same date a Petition,praying for the probate
<br />of said Will was filed by Grace E.Dinsmore, Geo. E.Devereaux, Ruth E.McGrath and William D.Dever-
<br />aux,Jr., children of the deceased, asking for probate of said instrument and the appointment of
<br />William D.Devereaux, Jr., as the Executor, as named in said Will.
<br />4. That on February 13, 1936, after notice of hearing thereon had been given by publication
<br />according to law, said Will was by this Court duly admitted to probate, and a Decree entered
<br />approving, proving, probating and allowing said_ instrument as the last Will and Testament of said
<br />deceased, and a copy of said Will and Certificate of Probate thereof is as follows:
<br />"In the Name of God, Amen. I, William D. Devereaux, of Hastingv, in the County of Adams, State of
<br />Nebraska, being of sound mind and memory and considering the uncertainty of this frail and transi-
<br />tory life, do therefore make, ordain, publish and declare this to be my last Will and Testament:
<br />First: I order and direct that my Executor hereinafter named, pay all my just debts and funeral
<br />expenses as soon after my decease as coravenlently may be.
<br />Second, After the payment of such funeral expenses and debts, I give, devise and bequeath unto my
<br />wife, Cynthia A.Devereaux, the entire net income and rentals from the North East Quarter of Section
<br />Twenty Six (26), in Township Nine (9), Dbrth,Range Ten (10),West of the 6th P.M., in Hall County,
