<br />by publishing; a notice of said order in the Grand Island Independent, a legal newspaper, printed and
<br />published in said county three successive weeks prior to said day of hearing, and it appears by
<br />proof on file that notice of said order was given as ordered by this Court.
<br />FOURTH: The Court further finds that on the 5th day of March, 19381 said last will and testament
<br />was duly approved, proved and allowed as the last will and testament of Marie Wilke, deceased, a
<br />decree of probate was made thereon, and Herbert F.Mayer was upon his giving bond in the sum of
<br />$4,000.00, as ordered by this Court, appointed administrator with said will annexed; that'said last
<br />will and testament is in words and figures following:
<br />THE LAST WILL OF MARIE WILKE.
<br />I, Marie Wilke, make this my last will hereby revoking all former wills.
<br />I hereby give and devise all my property, real, personal and mixed wherever situate to my nephew
<br />and nieces as follows, to my nephew Emil Jorgensen of Cleveland, Ohio, and to my nieces, Anna
<br />Scherz and Margaretha Stupick and Phoebe Titholm of Valparaiso, Indiana, share and: share alike.
<br />I desire to be buried in a metal casket in the Grand Island Cemetery.
<br />I discover that the scrivener has described one niece as Phoebe Titholm while it should have been
<br />Wiebke Titholm.
<br />Done at Grand Island this 9th day of. April, 1937.

<br />I, Paul N.Kirk, Judge of the County Court in and for said County, do hereby certify that on the
<br />10th day of February, 193$, the instrument purporting to be the last will and testament of Marie
<br />Wilke, deceased, vas filed for probate in this Court. That on the 5th day of March, 1935, said
<br />instrument to which this certificate is attached was duly proved, probated and allowed as the last
<br />will and testament of the real and personal estate of said Marie Wilke, deceased, and the same was
<br />ordered to be recorded in the records of the Court aforesaid.
<br />In Witness Whereof I have hereunto set my hand and affixed the seal of the County Court this 5th
<br />day of March, 1938.

<br />The Court further finds that the deceased at tree time of her death was a widow and that she left no
<br />children nor heirs at law her surviving, excepting the following: Emil Jorgensen, a nephew, and
<br />Anna. Scherz, Margaretha Stupick, and Phoebe Titholm, nieces.
<br />FIFTH: That on the 7th day of March, 1938, an order of this Court was made allowing creditors
<br />three months from and after the 30th day of March, 1938, in which to file their claims against
<br />said estate, and said Herbert F.Mayer, as administrator with will annexed of said estate one year
<br />in which to settle said estate, and further ordering that a notice of the same be published in the
<br />Grand Island Independent, a legal newspaper printed, published and circulating in said county three
<br />consecutive weeks prior to the 30th day of March, 1938, and it appears by proof on file that notice
<br />of said order was published as ordered by this court.
