<br />terested by publishing a notice of said order in the Grand Island Daily Independent, a legal news-
<br />paper printed in said County, for three successive weeks prior to the date of said hearing, and it
<br />appears by proof on file that notice of said order was published as ordered by this Court.
<br />THIRD.
<br />The Court further finds that on the 24th day of October 1929, said will was duly proved and allowed
<br />as the last will of said Alonzo J.Benson, deceased, a decree of probate was made and entered thereon
<br />and the bond of the said William Albert Benson was fixed in the sum of $2,000.00;
<br />FOURTH.
<br />That on the 14th day of February, 1930, the said William A.Benson, having failed to file bond as
<br />provided by the Court and having refused to qualify and act as executor, he, the said William A.
<br />Benson, requested this Court to appoint some other suitable person to act as administrator with
<br />the will annexed, to -wit: Cora May Bush, and the Court thereupon accepted the resignation of the
<br />said William Albert Benson and fixed the bond of the said Cora May Bush at $2,000.00, whereupon the
<br />said Cora May Bush.qualified and her bond was approved and she entered upon the duties of the office
<br />of administratrix with.the will annexed.
<br />Said will is in words and figures as follows:
<br />LAST !MILL AND TESTAMERTT OF ALONZO J.BENSON, GRAND ISLAND, NEBRASKA.
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />I, Alonzo J.Benson, of Grand Island Hall County, Nebraska, being of sound mind and memory, but not
<br />unmindful of the uncertainties of human life, do hereby make, publish and declare this,my last Will
<br />and Testament, hereby revolting all former wills by me made;
<br />1.
<br />I direct that my just debts and funeral expenses be first paid out of my estate.
<br />11.
<br />I hereby give ' -,devise, and bequeath unto my beloved wife, Lydia B.Benson, the following described
<br />real estate, o -wit, The South Half (Sj) of the East Half (E2) of the Southeast Quarter (SE4) of
<br />Section Twenty -eight (28), Township Ten (10), North, of Range Nine (9 ),West of the 6th P.M. in
<br />Hall County, Nebraska, for and during her natural life, and at her death, to my Son, William Albert
<br />Benson for and during his natural life, and at his death, unto his children and their heirs by
<br />right of representation, in fee simple absolute, share and share alike.
<br />In the event my said Son, William Albert Benson shall die without issue, his share shall pass and
<br />descend to his heirs by right of representation in fee simple absolute, share and share alike.
<br />111.
<br />Grandson, William H.Benson, to be theirs absolutely, share and share alike; and to that end, I here-
<br />by grant to the said William Albert Benson,.:full.power to sell and convey such property; to make,
<br />execute and deliver any contracts, bills of sale, or deeds, which may be necessary to transfer and
<br />convey said property, or any part thereof, with the same power as though he himself, owned said
<br />property in fee simple absolute.
<br />iv.
<br />I hereby nominate, constitute and appoint my son, William Albert Benson, to be the executor of this-
<br />The rest and
<br />residue of.my estate, both real and personal of which I may die possessed and where,
<br />ever situated, I hereby give,
<br />grant, devise and bequeath unto my son, William Albert Benson, as
<br />Trustee, and
<br />I hereby direct
<br />him as such Trustee to sell the same as soon as possible and from
<br />the proceeds
<br />thereof, to pay
<br />first, such of my debts, funeral expenses and the costs of probating
<br />my estate as
<br />shall be unpaid,
<br />and to pay over the balance remaining to my beloved wife, Lydia B.
<br />Benson, to be
<br />hers absolutely, but in the event of her death, prior to the time of such distribu-
<br />tion, then any balance shall
<br />be paid to my son, William Albert Benson, my daughter, Cora May Bush,
<br />My daughter,
<br />Ida May Sparks,
<br />Myrle Sallinger, the son of my deceased adopted daughter, and to my
<br />Grandson, William H.Benson, to be theirs absolutely, share and share alike; and to that end, I here-
<br />by grant to the said William Albert Benson,.:full.power to sell and convey such property; to make,
<br />execute and deliver any contracts, bills of sale, or deeds, which may be necessary to transfer and
