K irk, <br />County Judge. <br />IN THE MATTER OF THE ESTATE <br />OF <br />HENRY B.KELLEY, <br />DECEASED. <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />FINAL DECREE. <br />Paul N.Kirk <br />County Judge <br />NOW on this 5th day of October, 1938, this cause came on to be heard upon the final report filed <br />herein by Charles B.Kelley, administrator with will annexed of said estate, together with his <br />petition for the approval and allowance of said report, determination of heirs, settlement of said <br />estate, and his discharge. herein, and the court having examined the files and records of said estate, <br />including said report and vouchers attached thereto, and being fully advised in the premises finds <br />as follows: <br />That Henry B.Kelley, deceased, departed this life, testate, a resident of Hall County, Nebraska, <br />on the 18th day of October, 1937, leaving an instrument purporting to be his last will and testa - <br />nent which was duly admitted to probate in this court, as and for his last will and testament, on <br />the 1st day of December, 1937, and the said Charles Wm.Kelley appointed administrator with will <br />annexed of said estate, and he immediately qualified as such by filing his bond, as provided by <br />law, receiving letters of administration to administer said estate; <br />That said decedent departed this life the owner of an estate to be administered in said Hall County, <br />consisting of both real and personal property; said personal property being reduced to cash in the <br />amount of $1913.322 of which $1352.92 was expended in payment of claims filed and allowed against <br />said estate, funeral expenses, costs of administration and attorney fees, more particularly iden- <br />tified and set out in said administrator's final report; said real estate described as Lot one (1) <br />Block one hundred thirty -six (136), Union Pacific Companies Second Addition to the City of Grand <br />Island,Hall County, Nebraska, Lot ten (10), Block seventy -eight (78) Wheeler and Bennetd third <br />addition to the City of Grand Island,Hall County, Nebraska, Section nine (9), Township fifteen (15) <br />Range eighteen (18), Block letter "M ", Custer Addition to the Village of Anse, Custer County, <br />Nebraska, according to the recorded plat thereof in the Register of Deeds office in said county <br />and consisting of six (6) acres. <br />That by the terms and provisions of the last will and testament of said decedent, all of his <br />property, including both real and personal, and wherever situate, was devised and bequeathed to <br />the wife, Mary J.Kelley, absolute in fee simple title, and the said Mary J.Kelley, having prede- <br />ceased her husband, the testator herein, said estate both real and personal would descend to their <br />eight children in equal shares, namely; Charles William Kelley, a son of Grand Island, Nebraska; <br />Loye Edward Kelley, a son of Broken Bow., Nebraska; Dora May Crapscy, a daughter of Glen Rock, <br />Wyoming; Alice Priscilla Rapp, a daughter of Ansley, Nebraska; Isaac Ralph Kelley, a son of Grand <br />Island,Nebraska; Annie Gladys Juker, a daughter of Berwyn, Nebraska; Hattie Minerva Longfellow, a <br />daughter of Merna,Nebraska; Violet Beatrice Deeds, a daughter of Grand Island,Nebraska, in fee <br />simple title, each taking an undivided one - eighth interest in and to the real estate here inbefore <br />1 <br />J <br />1 <br />1 <br />
