THE AUGUSTINE CO. 18600.1$•86 <br />the presence of us who at his request have subscribed out names thereto as witnesses in his presence <br />and in the presence of each other. <br />/s/ Sabina Ryan <br />/s/ Mary Ryan <br />/s/ Wm.P.Mullen <br />ENDORSE21ENT: LAST WILL AND TFSTAkENT OF OWEN MULLEN of Wood River, Nebraska. <br />HALL COTTNTY, NEBRASKA F I L E D OCT 21 1937 PAUL N.KIRK, COUNTY JUDGE. <br />CODICIL TO THE LAST WILL AND TESTAMENT <br />OF OWEN MULLEN <br />I, Owen Mullen of Wood River, Hall County, Nebraska, declare this to be a first Codicil to my <br />Will which bears date of October 16, 1936. <br />WHEREAS, by my said Last Will, in paragraph Five thereof, I gave, devised and bequeathed to my I son, <br />John Mullen, the income from my real estate for the year in which I should die, in the event that <br />I did not die in 1936; <br />And WHEREAS, I have incurred certain expenses since the time of drafting said Will, which has used <br />up a portion of the cash which I expected to have on hand at the time of my death; <br />And WHEREAS, there are certain other bequests which I desire to make, as well as to insure the payment <br />of the expenses in connection with my last sickness and probating of my estate. <br />Now, I hereby revoke that portion of Paragraph Five of my said Last Will and Testament of giving <br />to my son, John Mullen, the crops from my said 240 acres of land for the year in which I die, and <br />hereby substitute therefor the following: That my said son, John Mullen, shall receive the income <br />from 240 acres of land for the year following the year of my death, but that the said John Mullen <br />shall be required to pay the real estate taxes on all of said 240 acres of land which shall be <br />assessed against said land for said year (my intention being that if I should die during the year <br />1937 that the said John Mullen is to receive the crop for the year 1938, and shall be required to <br />pay the real estate taxes levied for the year 1938, and likewise if my death occur subsequent to <br />1937)- <br />I further revoke the provisions provided for in Paragraph Eight of my Last Will and Testament drawn <br />under date of October 16, 1936, to read as follows: I further order and direct that whatever <br />cash money I have on hand at the time of my death, or which may be derived from the sale of my <br />interest in the crops grown on my real estate hereinbefore described, I desire that my executor <br />heretofore named in said Last Will and Testament shall use the same as follows: <br />First. That he shall pay the $100.00 special bequest to the St.Mary's Cemetery Association in Wood <br />River, Nebraska, as provided for in Paragraph Two of my said Last Will and Testament ;. <br />Second. I hereby specifically authorize said Executor to pay to Reverend T.D.Sullivan, Reverend J.P. <br />Monaghan and Reverend John Madsen $20.00 each for the purposes of saying masses for the <br />souls of myself and my departed wife. <br />Third. I order And direct that he pay all of my funeral expenses and expenses in connection with <br />riy Last illness. <br />Fourth. That he pay any and all just claims that may be filed against my estate. - <br />Fifth. That he pay the costs of probating my Last Will and Testament. That if there be any money <br />on hand in addition thereto I hereby give, devise and bequeath to my said son, Edward Mullen; <br />however, in the event that there is not sufficient money on hand including the sale of any <br />crops which I have on hand I hereby require that the following named persons viz., Leo P. <br />Mullen, John Mullen, Nellie Mullen and Harriet Mullen shall equally advance a fund suf- <br />ficient to take care of such deficit, and I hereby make a charge against the bequest and <br />devise hereinbefore made to each of said above named persons and against the property here - <br />inbefore bequested to them and each of them. That any deficit remaining be taken care of <br />by them in equal proportions. <br />I hereby revoke the provisions of Paragraph Ten,of my Last Will, the same being with reference to <br />my residuary estate and instead of those named therein, viz., Nellie Mullen, John Mullen, Leo P. <br />Mullen and Harriet Mullen, I substitute the name of my son Edward Mullen. <br />I hey °eby confirm my said Last Will drawn under date of October 16, 1936, in all other respects. <br />IN WI`.CNESS WHEREOF, I have hereunto subscribed my name and affixed my seal this 10th day of July, <br />1937• /s/ <br />orlen <br />Testa <br />• <br />
