Mark G.Lee, of Shelton, Buffalo County, Nebraska, being of sound mind and disposing memory, do make, and publish this, my last will and testament, that is to say: . FIRST. I give and bequeath to my daughter, Blanche Lee Smith, of Shelton, Nebraska, the sum of Five Hundred Dollars ($500.00). SECOND. I give and bequeath to my daughter, Addie W.McLeod, of Shelton, Nebraska, the sum of Four Thousand Five Hundred Dollars ($4500). THIRD. I give and bequeath to my daughter, Vivian Lee Hackman, of ::Shelton, Nebraska, all of the personal property, consisting; of live stock and farm equipment, owned by me and now in her possession, to- gether with all increase and addition thereto, as the same may be at the time of my death. FOURTH. I give and bequeath to my son, Mark H.Lee, of Shelton, Nebraska, the sum of Three Thousand Dollars ($3000). FIFTH. I give and bequeath to Rudolph W.McLeod and Mark H.Lee, and the survivor thereof, and to their successors in trust, as trustees for my daughter, Marie Lee Robbins, of Hastings, Iowa, under the terms and conditions hereinafter set forth, the sum of Four Thousand Seven Hundred Dollars ($4700). SIXTH. After the payment of my indebtedness, if any, and the expenses attending my burial and the admin- istration of my estate, and after the payment of any legacies hereinbefore set forth, I give, devise and bequeath all the rest, residue, and remainder of my estate, real, personal, and mixed, in equal one -fifth shares to the said Blanche Lee Smith, Addie W.McLeod, Vivian Lee Hackman, Mark H.Lee, and to the said Rudolph W.McLeod and Mark H.Lee as trustees as aforesaid, under the terms and conditions hereinafter set forth. In case of the death of any of my said children before the time of my death, I give, bequeath and devise the shade to which he or she would be entitled, under the terms of this will, unto his or her surviving children, in equal undivided shares. SEVENTH. In making the provisions contained in.this will, I have taken into account all advancements here - tof,ore,made by me to my said children, or any of them. In the event that I shall hereafter make advancements to any of my said children which shall be evidenced by promissory note or notes bear- ing date subsequent to the execution of this last will and testament and which note or notes shall be held by me at the time of my death, then all such advancements, so evidenced, shall be deducted from the share of the child or children obligated upon said note or notes. EIGHTH I hereby direct that the said trustees, Rudolph W.McLeod and Mark H.Lee, and the survivor thereof, and their successors in trust, shall control and manage that part of my estate hereinbefore be- queathed and devised to theiA, with authority to sell, transfer, and convey any real estate, or interest in real estate, belonging thereto, and to invest and re- invest all funds belonging thereto, and to pay all of the net income from the principal of said trust estate annually, or oftener if they shall deem it advisable, to my said daughter,.Marie Lee Robbins, during her natural life, and empower my said trustees in their discretion, if the same shall be necessary for the support, main- tenance, and comfort of the said Marie Lee Robbins, to pay her such sums from the principal of said trust estate as may be necessary for such purpose, and as such necessity may arise. The amounts due and payable to the said Marie Lee Robbins shall not be alienable by her, either by assignment or by any other method, and shall not be subject to be taken by her present or future creditors by any legal process whatsoever, and shall not pass to any assignee, trustee, or receiver, of the said 1 1 u L 11
