<br />The foregoing instrument, consisting of six (6) typewritten sheets, including this sheet (each
<br />sheet being identified by the signature or initials of the testator), was subscribed, published.
<br />and declared by the above named testator to be his Last Will and Testament, in the presence of us,
<br />who, in his presence, at his request, and in the presence of each other, have hereunto subscribed
<br />our names as witnesses; and we declare that at the time of the execution of this instrument the
<br />said testator, according to our best knowledge and belief, was of sound mind, and memory and under
<br />no constraint.

<br />FINAL DECREE.
<br />NOW, on this 22nd day of December 1936, this cause came on to be heard upon the final report filed
<br />herein by B.J.Cunningham, administrator with will annexed of the estate of John Peters, deceased,
<br />in the State of Nebraska, together with his petition for the approval and allowance as and for his
<br />final report, determination of heirs, settlement of said estate, and his discharge herein, and the
<br />court having examined the files and records, including said final report and the vouchers attached
<br />thereto, and being fully advised in the premises finds as follows:
<br />That the said John Peters departed this life, testate, a resident of Denver County, State of
<br />Colorado, on the 16th day of December; 19311, leaving a last will and testament which was duly and
<br />legally admitted to prob ate in the County Court of Denver County, State of Colorado, on the 25th
<br />day of January 1932 and proceedings had therein to administer said decedent's estate in the State
<br />of Colorado in accordance with the terms and provisions of said will;
<br />That thereafter on the 30th day of July 1935, Mary E.Peters offered her petition in this court,
<br />togeth.er with the authenticated copies of the last will and testament and probate thereof of John
<br />Peters, deceased, and proceedings had thereon as provided by law for the probate of foreign wills
<br />in the State of Nebraska, and said authenticated copies of will and probate from the county court
<br />of Denver County, State of Colorado, were duly received and admitted to probate in this court as
<br />the last will and testament of John Peters, deceased, on the 6th day of July 1936, and B.J.Cunningham
<br />appointed administrator with will annexed to administer said decedent's estate in the State of
<br />Nebraska, and said B.J. Cunningham did qualify as such administrator by filing his bond as provided
<br />by law and receiving Letters of Administration with will annexed to administer said estate;
<br />That said decedent departed this life the owner of an estate situate in Hall and Custer Counties,
<br />State of Nebraska, consisting entirely of real estate described as the best half (W *) of Section
<br />twenty -one (21),Township eleven (11),North, of Range eleven (11),West of the 6th P.M.,Hall County,
<br />Nebraska, containing 320 acres, a little more or less, as well as the Soullwest quarter (SWJ) of
<br />section ten (10), Township fourteen (14) North, of Range twenty -two (22), containing 160 acres, a
<br />little more or less, situate in Custer County, Nebraska, which, by the terms and provisions of said
<br />testator's will, said real estate described as the Southwest quarter of Section ten (10),Township
<br />fourteen (14) North of Range twenty -two (22) containing 160 acres, a little more or less, in Custer
<br />Counts, Nebraska, was devised to Frank Peters, a brother of La Platte, Nebraska, in trust for the
<br />benefit of testator's sister, Ellen Anderson, according to the terms and provisions of paragraph
<br />two and the subdivisions thereof of said will; and further by the terms and pprovisions of paragraph
<br />Four of said will, said real estate described as the Vest half (Wj) of Section twenty -one (21),Town-
