170 <br />IT) 16) 1 ��Mrk� <br />THE AUGUSTINE CO. 18600 -12.86 <br />tration in said estate, including the executors fees and the attorney's fees, have been paid and <br />distribution made by said executor in accordance with the terms of said last will and testament of <br />Sophia Bockmann, deceased, and that any claims not filed against this estate are,,�`i`oever barred and <br />enjoined from being asserted against this estate or any part thereof. <br />TENTH. <br />The Court further finds that Arthur Bockmann, (see Case No. 2596 in this Court), one of the devisees <br />named in the will of Henry Bockmann, deceased (Case Nj. 355) filed and admitted to probate in this <br />Court, departed this life intestate and an unmarried man, without issue, and that said Sophia Bock- <br />mann was the mother of said Arthur Bockmann and his sole heir at law and the provisions in the said <br />Henry Bockmann will in favor of. said Arthur Bockmann, by which the said Sophia Bockmann was obligated <br />to pay, during her lifetime or provide for in her last will, passed to said Sophia Bockmann and <br />passed to the said Theodore Bockmann, James Bockmann and George Bockmann under the provisions of the <br />residuary clause in the will of the said Sophia Bockmann, deceased.. <br />ELEVENTH: <br />The Court further finds that Gus Bockmann, sometimes known as Gustav Bockmann (see Case No. 1943 in <br />this Court) one of the devisees named in the will of the said Henry Bockmann, departed this life <br />intestate and an unmarried man, without issue, and that said Sophia Bockmann was the mother of said <br />Gus Bockmann and his sole heir at law and the provisions in the said Henry Bockmann will in favor <br />of said Gus Bockmann, by which the said Sophia Bockmann was obligated to pay, during her lifetime <br />or provide for in her last will, passed to said Sophia Bockmann and passed to the said Theodore <br />Bockmann, James Bockmann and George Bockmann under the provisions of the residuary clAilse in the <br />will of the said Sophia Bockmann, deceased. <br />TWELFTH: <br />The Court further finds that Katie Baasch is one of the devisees named in the will of the said <br />Henry Bockmann, and that she has been paid in full and has released all her right, title and interest <br />in the estate of the said Sophia Bockmann under and by virtue of the provisions contained in her <br />favor in the last will of the said Henry Bockmann, deceased. <br />THIRTEENTH: <br />The Court further finds that Dora Wiese is one of the devisees named -in the will of the said Henry <br />Bockmann, and that she has been paid in full -and has released all her right, title and interest in <br />the estate of the said Sophia Bockmann under and by virtue of the provisions contained in her favor <br />in the last will of the zaid Henry Bockmann, deceased. <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of the executors <br />in said estate be and the same is hereby approved and allowed as such; further that the property <br />described in paragraph Sixth he�eof descends according to the terms and provisions of said last <br />will and testament and the finding of this Court in paragraph Seventh of this decree; further that <br />said executors have filed proper receipts showing payment of all debts, claims, expenses of adminis- <br />tration, court costs, attorney's fees and executor's fees and receipts from each of the legatees <br />named in said last will showing that each of .them has received his or her distributive share of this <br />estate as set forth in said last will and has received the legacies provided in the last will of <br />Henry Bockmann, deceased (Case No. 355 in this Court) and that the legacies provided in said will <br />of Henry Bockmann have been fully paid and satisfied and that an order of discharge be and the same <br />is hereby issued to James Bockmann and Theodore Bockmann discharging them and their surety from any <br />further duties or liability in this cause out of and under seal of this court, and it is ordered that <br />this case be closed and this final decree -be entered in the probate records in this Court. <br />IN WITNESS WHEREOF, I.HAITE hereunto set my hand and the seal of the County Court at Grand Island, <br />Nebraska, this 27th day of August, 1938.
