last will and testament of the real and personal estate of said Henry J.Bartenbach, deceased, and <br />the same was ordered to be recorded in the records of the Court aforesaid. <br />IN WITNESS WHEREOF I have hereunto set my hand and affixed the seal of the County Court this 26th <br />day of December, 1933• <br />(SEAL) Paul N.Kirk <br />County Judge. <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />In the matter of the estate <br />of ) FINAL DECREE. <br />Henry J.Bartenbach, Deceased. ) <br />Now, on this 10th day of August, 1939, this cause came on for hearing upon the supplemental and final <br />report of George W.Bartenbach and Elfrieda Bartenbach, Executors under the last will and testament <br />of Henry J.Bartenbach, deceased, and upon their petition for final settlement, and discharge. <br />The Court, having examined the report, the records and files in said estate, and being duly advised, <br />in the premises, finds that due and legal notice has been given to all persons interested in said <br />estate of the time and place fixed for hearing said final report, and as heretofore ordered by the <br />Court, and there being no objections to said report, the Court having examined the same, together <br />with the vouchers and files, and being duly advised, finds that said report is true and correct in <br />all things and ought to be allowed as and for the final report of said executors, and that they be <br />discharged. <br />The Court further finds that Henry J.Bartenbach departed this life on the 27th day of November, 1933, <br />that at the time of his death he was a resident and inhabitant of Hall County, Nebraska, that on the <br />2nd day of December, 1933, a petition was filed herein for the probate of the last will and testa- <br />ment of said Henry J.Partenbaeh,deceased, that the Court thereupon fixed December 26, 1933, as the <br />date for hearing, and due notice thereof was given as by law provided, and on the 26th day of Decem- <br />ber, 1933, said last will and testament was proven, allowed, and admitted to probate as and for the <br />last will and testament of Henry J.Bartenbach, deceased, and George W.Bartenbach.,and Elfrieda Bar- <br />tenbach thereupon duly qualified as executors, <br />The Court further finds that Henry J.Bartenbach left surviving him, as his sole and only heirs at <br />law, legatees, and devisees, the following: <br />Elfrieda Bartenbach, widow, <br />Helen Connell, daughter, <br />Henrietta Baer, daughter, <br />George W.Bartenbach, son, <br />all being of legal age, and residents of Grand Island,Hall County, Nebraska. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed for filing claims, that all claims filed against said estate have been settled and paid, <br />and that the time for filing claims has expired. <br />IT'IS, THEREFORE, ORDERED AND ADJUDGED BY THE COURT that all claims, if such there be, and not filed <br />herein against said estate, such claims are forever barred and precluded. <br />The Court further finds that Henry J.Bartenbach at the time of his death was the owner of the follow- <br />Ing described real estate: <br />Lots 4 and 6 in Block 23 in Scarff's Addition to the city of Grand Island. <br />Lots 5 and 6, in Block 106, in Railroad Addition to the city of Grand Island. <br />Part of Lot 15 of County Sub - division of the west half of the southwest quarter of Section 15, in <br />Township 11, Range 9; that part of Lot 14 of the County Sub- division of the west half of the south- <br />west quarter of Section 15, Township 11 North, Range 9 west of the 6th P.M., which lies west of Pine <br />Street in the city of Grand Island,Hall County, Nebraska, and abuts on the south 110 feet of Lot 15 <br />of said County Subdivision; <br />A parcel of land described as follows: commencing at <br />in the Original Town, now pity of Grand Island, as sl <br />thence southerly along the easterly line of said lot <br />99 feet, parallel with the south line of said block; <br />parallel with the easterly line of said block to the <br />easterly, along the mrtherly line of said Lot 7 and <br />the northeasterly corner of Lot B in Block 65 <br />town by the recorded plat thereof; running <br />55 feet; thence westerly, at a right angle, <br />thence northerly, at a right angle, 55 feet, <br />ort erly ce line of Lot 7 in said block- thence <br />o <br />9y feet _to the _01a" of begl;tn1ng; - -and <br />
