150 <br />THE AUGUSTINE CO. 18800.12 -88 <br />FINAL DECREE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA... <br />In the Matter of the Estate ) <br />of ; FINAL DECREE. <br />ALBERT WINTER, DECEASED. ) <br />Now on this 27th day of November, 1920, this cause came on for hearing upon the final report of <br />Agnes Winter, Administratrix of the estate of Albert Winter, deceased, having been duly adjourned <br />from the 6th day of November, 1920, and it appearing to the court, from the proof now on file, that <br />notice to all persons interested of the filing of said report and of the time and place fixed for <br />final settlement of said estate as required by order of court dated October 23, 1920, and there <br />being no objection or protest on file. <br />After a full examination of said report and on consideration of the evidence in support thereof, <br />the court finds that said administratrix has accounted for all of the estate of said deceased which <br />came into her possession or under her control and that her report is correct in all respects and <br />ought to be allowed. <br />The court finds that notice was given to creditors of said deceased as to the time allowed and place <br />appointed for filing claims against said estate; that the time so allowed for filing claims has <br />fully expired and that all claims and demands outstanding against said deceased or his estate, if <br />any such exist, are therefore forever barred and excluded. <br />The court further finds that there remains in the hands of the administratrix for distribution <br />personal property of the value of $3220.02, and that this should be distributed as follows: <br />113 part thereof to Agnes Winter, widow of the said Albert Winter, and <br />2/3 part thereof to the three children of said deceased, in equal shares. <br />The.Court finds that the said Albert Winter departed this life on the 15th day of February, 1920, <br />being at the time of his death.a resident of Hall County., Nebraska, and that he died intestate <br />leaving surviving him as his heirs at law and his only heirs at law, the following named persons: <br />Agnes Winter, his widow, and Edna Winter, Fred Winter and Ruth Winter, his children; that he died <br />siezed in fee of the following described real estate situate in the County of Hall and State of <br />Nebraska, to -wit: <br />The Northwest Quarter of Section.Ten (10), Township Twelve (12), Range Nine (9) West of the 6th P.M. <br />The North Half of the Northwest Quarter (N'ffNVQ&) of Section Twenty seven (27), in Township Twelve <br />(12) in Range Nine (9), West of the 6th P.M. <br />Lot Number Ten (10), in Block Sixty -four (64), in Wheeler & Bennett's Addition to the City.of <br />Grand Island. <br />Lots Seven (7) and Eight (8), in Block Ei ht (8), in George Loan's Subdivision of Section Ten (10) <br />in Township Eleven (11), in Range Nine (9�. <br />Lots Eight (8), Nine (9) and Ten (10), in Block Twelve (12), in Gilbert's Addition to the City of <br />Grand Island, <br />Lots Six (6) and Seven (7) in Block Thirty Three (33), in Packer and Barr's Addition to the City <br />of Grand Island, <br />The Court finds that the said Agnes Winter is the mother of all of the Children of the said Albert <br />Winter and that under and by virtue of the law of descent of the State of Nebraska, all of the above <br />mentioned and described real estate did descend at his death in the manner following: <br />To Agnes Winter one -third part thereof in fee; <br />To Edna Winter, Fred Winter and Ruth Winter, children of the said Albert Winter, two thirds part <br />thereof in equal shares, subject to the homestead rights of the said Agnes Winter, his widow, in <br />and to the Northwest Quarter of Section Ten (10), in Township Twelve (12), in Range Nine (9) in <br />Hall County, Nebraska. <br />It is, therefore, by the court, <br />CONSIDERED, ADJUDGED AND DECREED, That all of the right, title and interest of the said Albert <br />Winter in and to all of the above mentioned and described real estate did pass and descend at his <br />death, in accordance with the law of descent of real estate in the State of Nebraska, as follows: <br />
