<br />Now on this 16th day of July, 1938, this matter comes on for hearing upon petition of Charles
<br />A.Porth, executor of the estate of Anna Uden, deceased, for final settlement and distribution,
<br />and for his discharge as executor.
<br />The Court finds that on the 18th day of February, 1938, Charles A.Porth, as provided by the terms
<br />of the will, was duly appointed by this court as executor of this estate; that he afterwards made
<br />and filed his bond and took the oath as required by law and letters testamentary were issued to
<br />him and he became the duly qualified and acting executor of said estate.
<br />The Court finds that on the 26th day of January, 1938, Anna Uden departed this life in the city of'
<br />Hastings, Adams County, Nebraska, and was at the time of her death a resident of said city, county
<br />and state, and that she left a last will and testament in which the said Charles A.Porth was named
<br />executor, and which will was heretofore and on the 18th day of February, 1938, duly proved and ad-
<br />mitted to probate as the last will and testament of said deceased, and which last will and testa-
<br />ment and the certificate of probate thereof are in words and figures as follows:
<br />LAST WILL AND TESTAMENT OF ANNA UDEN
<br />847 Webster Avenue, Hastings, Nebraska.
<br />I, Anna Uden, now residing at 847 North Webster Avenue, city of Hastings, Adams County, Nebraska,
<br />of sound mind and memory, and knowing the uncertainty of this mortal life, do make and publish
<br />this my last will and testament as follows:
<br />FIRST: I direct my executor hereinafter named, to pay all of my just debts and the costs of admin-
<br />istering upon my estate out of the proceeds derived from my personal property, and if my personal
<br />property shall be insufficient for such purpose, then I direct my executor hereinafter named to sell
<br />my real estate, or so much thereof as may be necessary for that purpose, and this shall be his power
<br />and authority to so do and all without the intervention of a court.
<br />SECOND: I direct my executor hereinafter named to place a suitable monument at the graves and
<br />burial lot of myself and my deceased husband.
<br />THIRD: The residue and remainder of my property -of every kind and nature and wheresoever situated,
<br />I give, devise and bequeath to my beloved brother Charles A.Porth, to him and to his heirs forever.
<br />VOURTH: I hereby appoint my beloved brother Charles A.Porth executor of this my last will and testa -
<br />ment, hereby revoking all former wills by me made.
<br />IN WITNESS WHEREOF I have hereunto signed my name at Hastin s, Nebraska, this 21st day of October,

<br />We, whose names are hereunto subscribed, do hereby certify that Anna Uden, the testatrix, subscribed
<br />her name to this instrument in our presence and in the presence of each of us, and declared at the
<br />same time 14 our presence and hearing this instrument consisting of two typewritten pages, to be
<br />her last will- and testament, and we, at her request, sign our names hereto in her presence and in
<br />the presence of each other as attesting witnesses.

<br />Anna Uden, deceased, which was filed in this Court, on the 1st
<br />day of February A.D. 1938, and
<br />being the instrument to which this is annexed, was duly proved,
<br />approved, probated and allowed,
<br />as the last will and testament of the said Anna Uden, deceased,
<br />in and for the State of Nebraska;
<br />and it was ordered to be'recorded in the records of the County
<br />Court aforesaid,
