<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA.
<br />FINAL, DECREE.
<br />Now on this 29 day of June, 1938, this cause came on for hearing on the Final Report of Alfred
<br />Werner, Administrator de bonis non of the estate of Gustav Roby, deceased, and it appearing to the
<br />Court from the proofs on file that notice of the filing of said report and of the time fixed for
<br />hearing thereon has been given to all persons interested in the manner required by law and the order
<br />of this Court, and it further appearing to the Court, after a full examination that the account
<br />exhibited by said Administrator de bonis non is correct in all things and ought to be approved and
<br />allowed, and it further appearing that said Administrator de bonis non has accounted for all of said
<br />estate which has come into his hands, it is therefore,
<br />ORDERED, ADJUDGED AND DECREED that the report of said Alfred Werner, Administrator de bonis non of
<br />the "estate of Gustav Roby, deceased, be, and the same is, approved as and for his Final Report.
<br />The Court further finds that notice has been given to all creditors of said estate in the manner
<br />provided by lave of the time and place fixed for presenting claims against the estate of said de-
<br />ceased; that the time allowed for filing claims has fully expired; that all claims filed and
<br />allowed against said estate have been fully paid and satisfied; that the funeral expenses of said
<br />deceased and the costs of administering said estate have been fully paid and that all outstanding
<br />claims against said estate, not filed, if any such there be, are forever barred and excluded.
<br />It is, therefore, ORDERED, ADJUDGED AND DECREED by the Court that all persons are forever barred
<br />from filing or setting up any claims or demands against the estate of Gustav Roby, deceased, and -
<br />that such estate is fully settled and closed.
<br />The Court finds that said estate is not subject to any Inheritance Tax under the laws of the State
<br />of Nebraska.
<br />The Court finds that the said Gustav Roby departed this life on the 13th day of December, 1936,
<br />leaving a last will and testament in which his widow, Catharina Roby was named as Executrix, and
<br />which will was admitted to probate on the 12th day of January, 153 7. That during the process of
<br />administration the said Executrix did not draw on the checking account of deceased in the First
<br />National Bank of Grand Island in the sum of $143.92, being the only personal asset, and that the
<br />said Executrix departed this life during the process of administration. Tnat any disbursements
<br />made by her during her term as Executrix were paid from her personal funds, other than the personal
<br />property of deceased.
<br />That after the death of the said Catharina Roby, and on the 4th day of August, 1937, Alfred Werner
<br />was appointed Administrator de bonis non of the estate of said Gustav Roby,deceased, and has filed
<br />his Final Report in which he has accounted for all of the funds coming into his hands, and that the
<br />heirs at law of the said Catharina Roby, deceased, make no claim for tho disbursements made by the
<br />said Catharina Roby, deceased.
<br />The Court further finds that the said Gustav Roby died seized as the owner in fee simple, of the
<br />following described real estate situated in Hall County, Nebraska, to -wit:
<br />The East Half of the Northeast Quarter (EJ NEI) and the East Half of the Southeast Quarter (EJ SEI)
<br />of Section 35, Township 11, North,Range 10,`West of the 6th P.M. in Hall County, Nebraska;
<br />The East Half of the Northeast Quarter of the Northeast Quarter (EJ NEJ NEJ) of Section 2, Township
<br />10, North,Range 10, West of the 6th P.M. in Hall County, Nebraska,
<br />and that by the provisions of the last will and testament of the said Gustav Roby said real estate
<br />did pass and descend as follows:
<br />To Catharina Roby, wife of said deceased, a life estate, and the remainder thereof as follows:
<br />To John Roby, son of deceased, an undivided one- eighth interest therein;
<br />To Annie Werner, daughter of said deceased, an undivided one - eighth interest therein;
