120 <br />THE AUGU.TIHE CO. 18600.12.718 <br />at the time of his death he was a resident of said Hall County and that said deceased left a last <br />will which was filed in this Court for probate on the 15th day of December, 1937. <br />SECOND. <br />That said Johanna Busse was nominated in said will as executrix thereof and that the following are <br />the devisees named therein, to -wit : - Johanna Busse and Anna Busse Herman. <br />THIRD <br />That on the said 15th day of December, 1937, Johanna Busse filed in this Court a petition for the <br />probate of said will and the appointment of herself as executrix thereof; and on said day an order <br />of this Court was made therein assigning the 12th day of January, 1938, at 10 o'clock A.M, in said <br />Court Room as the time and place for hearing said petition and ordering that notice be given to all <br />persons interested in said matter by publishing a notice of said order in the Grand Island Independent <br />prior to said day of hearing, and it appears by proof on file that notice of said order was given <br />as ordered by this Court. <br />FOURTH. <br />The Court further finds that on said 12th day of January, 1938, said will was duly proved and allowed <br />as the last will of Henry Busse, deceased, a decree of probate was made thereon and Johanna Busse <br />named therein was, upon her giving bond in the sum of One Hundred Dollars ($100.00) as ordered by <br />this Court, appointed executrix thereof. <br />The Court further finds that the deceased at the time of his death was a resident of said Hall <br />County and that he left the following heirs -at -law; Johanna Busse, his widow, and Anna Busse Herman, <br />his daughter. <br />FIFTH. <br />That on the 12th day of January, 1938, an order of this Court was made allowing creditors three <br />months in which to file their claims against said estate and the executrix one year in which to <br />settle said estate from said 12th day of January, 1938, and further ordering that a notice of the <br />same be published in said newspaper three successive weeks prior to the 9th day of February, and <br />it appears by proof on file that notice of said order was published as ordered by this Court. <br />SIXTH. <br />The Court further finds that on the 21st day of January, 1938, the said executrix filed in this <br />Court her inventory of the property of said estate, and that according to said inventory the <br />deceased died siezed and possessed of the following described property, to -wit: Lot Six (6) <br />in Block Forty -four (44) of Russel Wheeler's Addition to the City of Grand.Island,Hall County, <br />Nebraska. <br />SEVENTH. <br />The Court further finds that according to the terms and provisions of saidwill and testament said <br />Lot Six (6) in Block Forty -four (44) of Russel Wheeler's Addition to the City of Grand Island, Hall <br />County, Nebraska,d6seends in fee simple to Johanna Busse and to her heirs forever. <br />EIGHTH. <br />The Court further finds that the time for filing claims herein has long since expired and thgt all <br />of the just debts and claims against said estate and the costs of administration in said estate have <br />been paid and if any claims there be outstanding against this estate, the same are hereby forever <br />barred and enjoined from being asserted against the above described property. <br />NINTH. <br />The Court further finds that there is no inheritance tax due the County of Hall, State of Nebraska, <br />nor the United States of America herein, all of said property of this estate being exempt under the <br />laws of this State. <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of Johanna Busse, <br />executrix under said last will and testament in said estate be and the same is hereby approved and <br />allowed as such; further that Mrs. Anna Busse Herman, daughter of said testator, and Johanna Busse, <br />1 <br />u <br />1 <br />d <br />
