<br />ANNA PROCHASKA, DECEASED. ))
<br />Now on this 18th day of May, 1938, at ten o'clock A.M. this cause comes on for hearing on petition
<br />of Frank Prochaska, administrator of said estate, praying for the allowance of the final report
<br />filed therein, for the finding of the liability of said estate for inheritance tax, and for decree
<br />of heirship and distribution, and discharge of the administrator.
<br />Upon consideration of the files and the evidence, the court finds that the said Anna Prochaska
<br />died intestate on the Sixth day of September, 1937, in Hall County, Nebraska, being at the time of
<br />her death a resident of said county and state, and being the owner of real estate and personal
<br />property therein; that she left as her only heirs at law the following children, all of legal age;
<br />Martin Prochaska, Mary V.Erazim, Frank Prochaska, James Prochaska, Anna Tomlinson, Joseph Prochaska,
<br />Barbara Hulme, Tonnie Cole; and John Prochaska, Carl Prochaska, Joseph Prochaska, Libbie Prochaska
<br />and Vanie Prochaska, grandchildren, all of legal age, being the children of John Prochaska, prede
<br />ceased son of the said Anna Prochaska, deceased.
<br />The court finds that the final report is correct and that the balance of @ash in the hands of the
<br />administrator at the time of filing said report was $1449.36; that since the filing of said report
<br />the administrator has paid to J:.H.Harrison, attorney for the administrator, the sum of $70;00 and
<br />to Frank Prochaska the sum of $10.08 for filing of decree and other expense of administrator. After
<br />such deductions the amount remaining in the hands of the administrator is $1369.25.
<br />The court finds that Joseph Prochaska, one of the heirs -at -law, has made an assignment and Wit
<br />claim deed of his interest in the estate to the other heirs -at -law therein ^the proportionate shares
<br />descending to them according to law, the consideration being that a promissory note for $679.00 and
<br />interest due from Joseph Prochaska to Anna Prochaska be cancelled, and the administrator is hereby
<br />directed to cancel said note and return it to Joseph Prochaska.
<br />The court further finds that there is in the hands of the administrator a note for the sum of
<br />$489.50, on which there is a balance due of $439.50 and interest, signed by A.P. Cole, husband of
<br />Tonnie Cole, one of the heirs named herein, said note being payable to the deceased Anna Prochaska.
<br />It is directed that the administrator indorse payment of the sum of $214.78 on said note, leaving
<br />a balance due of $224.72 and interest, and that said note be delivered to Frank Prochaska for dol-
<br />lection and distribution of the proceeds, and that said Frank Prochaska file with this court a
<br />receipt showing he has received said note.
<br />The court further finds that there is in the hands of the administrator a note for $187.50, on
<br />which there is a balance due of $87.50 and interest, said note signed by John Prochaska, predeceased
<br />son of Anna Prochaska, deceased, and payable to said deceased; that there is now due on said note,
<br />Including interest, the sum of $134.14, which said sum the administrator is directed to deduct-from
<br />the portion due to the descendants-- of the said John Prochaska, and that said note be cancelled.
<br />The court directs that the sum of $1369.28 remaining in the hands of the administrator be distri-
<br />buted by paying'to Martin Prochaska, Mary V.Erazim, Frank Prochaska, James Prochaska, Anna Tomlinson
<br />and Barbara Hulme each the sum of $214.79; and to the grandchildren, John Prochaska, Carl Prochaska.,
<br />Joseph Prochaska, Libbie Prochaska and Vanie Prochaska each the sum of $16.12, and that receipts
<br />showing such payments be filed with the Court.
<br />The court further finds that the deceased died seized of the Northwest Quarter of Section lc, in
<br />Township Eleven, Range Twelve, in Hall County, Nebraska; that by operation of law and consideration
<br />of a quit claim deed given by Joseph Prochaska and Arlie Prochaska, his wife, the above described
<br />real estate shall descend to Martin Prochaska, Mary V.Erazim, Frank Prochaska, James Prochaska.,
